Kolbe v. Hogan--4th Circuit Rules Firearms Safety Act Subject to Strict Scrutiny
4th Circuit Court of Appeals remanded Kolbe v. Hogan back to the District Court of Maryland today. The lower court is required to review the FAS under strict scrutiny.

A federal appeals court on Thursday cast doubt on the legality of Maryland’s 2013 ban on assault weapons and high-capacity magazines passed after the mass shootings at an elementary school in Newtown, Conn.
The 2-1 decision by a panel of the U.S. Court of Appeals for the 4th Circuit sends the gun-control law back to a lower court for review because it “implicates the core protection of the Second Amendment.”
In its majority opinion, written by Chief Judge William B. Traxler Jr., the court found that the Maryland law “significantly burdens the exercise of the right to arm oneself at home.”
In a strongly worded dissent, Judge Robert B. King wrote: “Let’s be real: The assault weapons banned by Maryland’s [law] are exceptionally lethal weapons of war” and as such, he said, not constitutionally protected."A man who has nothing for which he is willing to fight, nothing which is more important than his own personal safety, is a miserable creature and has no chance of being free unless made and kept so by the exertions of better men than himself"
