Firearms Disabilities for Certain Nonimmigrant Aliens (2001R-
332P)
AGENCY: Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF),
Department of Justice.
ACTION: Final rule.

SUMMARY: In 2002, the Bureau of Alcohol, Tobacco, Firearms, and
Explosives (ATF) published an interim final rule implementing the
provision of the Omnibus Consolidated and Emergency Supplemental
Appropriations Act, 1999, relating to firearms disabilities for certain
nonimmigrant aliens. That regulation implemented the law by
prohibiting, with certain exceptions, the sale or disposition of
firearms or ammunition to, and the possession, shipment,
transportation, or receipt of firearms or ammunition by, nonimmigrant
aliens.
The Department of Justice has now determined that the relevant
statutory prohibitions on transfer and possession of firearms and
ammunition apply only to nonimmigrant aliens who were admitted to the
United States under a nonimmigrant visa, and that the prohibitions do
not apply to nonimmigrant aliens who lawfully entered the United States
without a visa. The Department is therefore issuing this rule to make
conforming changes to the regulations, so that the regulations are
consistent with the Department's current legal interpretation.
This final rule addresses only the nonimmigrant alien visa issue.
The remaining issues raised by the 2002 interim final rule, and the
public comments submitted with respect to those issues, will be
addressed in a separate forthcoming rule.

Suffice it to say that there are minor changes to the ATF Form 4473 and a new ruling on nonimmigrant alien applicants.
There is also a new ruling on the 90 day proof of residency requirement, but I can't find it online at this time.
At this time I also do not see the new Form 4473 on the ATF website so this is more of a notification to the board that the new form is out there now and will be mandated soon. I cannot currently post a copy and do not know if I will be able to.

My new forms came in the mail today. I only glanced at the ATF letter because I rarely do sales or transfers at my home. Most sales get shipped elsewhere.

The number 4473 has stayed the same over the years, but the form has changed a number of times since the beginning, which I believe was late 1968 when the GCA 68 went into effect. In the early eighties, the form did not have the number of questions they have now.

Found the new form online now, as it appears the ATF has updated their website with it:

So if you haven't purchased recently you may notice the change in question 10, and on the matter of nonresident alien applicants later on the form as well.

If a FFL does not have the new ATF form 4473 they can't do a transfer???
I was going to do a gun trade this am & the FFL called me and stated he didn't have the new form so we could not do the trade! UGH!Last edited by 96D; July 13th, 2012 at 11:18 AM.

Cannot use old form BUT:
If you need additional forms, please contact the ATF Distribution Center at (202) 648-6420 or you may order online at http://www.atf.gov/forms/dcof/. You may also print the Form 4473 from the ATF website and make copies as needed.IANAL
