    Default Can there be any legal action against you for this situation!

    Say I knowingly carried concealed in a place such as the L.V. Mall where firearms are prohibited and a situation occurs where I need to draw my weapon. When push comes to shove can there be any legal action against me for knowingly not following the "rules". I see alot of threads where if a public place doesn't allow firearms people always post to just CC. Thats all fine and usually what I do, but can that bite me in the Ass in the end?

    Well if such a situation occurs, and you might be killed by a(n) assailant, would you rather be dead or face trespass charges?

    it is a possibility, i suppose. this is why situational awareness is so critical, especially in places like malls, or any other place with high concentrations of sheep gather.

    if you ever had to draw on someone in a place like that, the first step you should take, once you're safe, is call the police. someone will be calling anyway, so it'd be be better if you did it first. once they arrive, the mall would probably leave the situation to them, along with escorting you off the premises.

    all this is just hypothesizing, of course. i've never had to draw on someone in a mall, so take my advice for what it's worth.

    If the drawing of the weapon (and use of), is in a proper legal response to a threat, I see no legal ramifications of that.

    The only real issue is you violating private property rules. Unless the rules are obviously posted, or you were verbaly told them, or admit on a public forum you know them, I doubt you could be held liable for not knowing the rules.

    There's no question which I would pick but say it wasn't a mass shooting but more of a domestic dispute gone wrong where I felt the woman (or man in some cases) was in grave danger I pull my weapon the assault stops she doesn't want to press charges even though he was smashing her head into the ground and there I am left in cuffs getting hauled away and my ltcf revoked. Just one situation that comes to mind but you understand what I'm saying.

    I have a feeling we need our gun lawyer friend on this one, but Ill bet the reprocussions would be harsh being the malls have signs at every door abount no weapons and the fact that drawing let alone discharging a gun in a place with that many people would automatically make you the irresponsible, crazy person wether you were justified or not. Just my thoughts but it seems like a lose, lose proposition to me.

    You should NEVER insert yourself into a dispute where you don't know the details. It's possible that the "attacker" that you confront was justified in taking whatever action prompted you to intervene.

    Doubtful you would be hauled away in cuffs, but you would likely have a trespass summons.
