    Default I just bought a gun and I can't return it...

    ...so I go and sell it to someone. I know it's illegal to buy another gun for someone else and it's punishable by 10 years of prison. Would this be percieved if I were to sell a gun I bought a week ago that I can't return and I sell it to someone else? How does this work with the law? TIA.

    You're covered as long as you legally transfer the gun through an FFL.

    You need to do a legal transfer with the buyer at a FFL. As long as you sell it through an FFL and the buyer passes his backround check it's 100% legal.

    You know what, I bought another gun a while ago and a friend of mine was looking for the same gun and the store only had 2 left. I mumbled to the clerk that I may buy both and sell the second one to my friend through another FFL closer to home. The clerk amonished me and told me after saying that to him he could not sell me the second gun by law and I could be imprission for 10 years buying a gun for someone else. Was he BSing me? Change of topic, can I intend to buy a gun for someone and transfer the gun to them through an FFL?

    The guy who owns the local shop where I spend a lot of time and money told me this story once. A man came into his shop one Saturday morning bought a gun, and left. Later on that afternoon, well before closing time, another man came into the shop with the same gun wanting to trade it for something else. He told the owner that he didn't think it had been fired much. The owner laughed and replied that he knew it couldn't have been fired much since he sold it new that morning!

    What had apparently happened was that the first guy bought the gun, decided right away he didn't want it, and took it to another shop to trade it for something else. The second guy came in, snapped up a deal on a used but like new gun that he didn't really want, and so came to another shop to trade it for something he wanted. So this particular handgun passed through the hands of five people in one day, although #1 and #5 were the same person. And it was all legal.

    So as long as you do it right, time of possession really has nothing to do with it.

    You can sell a shotgun face to face without an FFL.

    It`s buying a gun for somebody that you know cannot legally buy their own that makes it a crime. If you transfer it legally there is no problem.
