    Default Giving a handgun as a birthday gift.

    Okay, so my girlfriend ordered a Bersa 9 UC for my 21st birthday from budsgunshop.com and we had it sent to cabelas in hamburg for the FFL transfer. When she ordered she wrote that it was a gift for me, but apparently they didn't tell cabelas about it. So what I want to know is if it's legal for her to gift the firearm to me or if we have to have it transferred through an FFL if she has to go pick it up.

    I think I remember reading that personal face to face gifts between two legally eligible persons doesn't require an FFL transfer. Am I completely wrong?

    I'm not positive on this one, but I think it'd have to be transfered to a person who is legally related (mother, father), in order to be gifted without a second transfer.

    Your gonna have to pick it up. Or if she picks it up you will have to have it transferred into your name at an ffl.

    You could get married before picking it up and then she can give it to you legally. Just a thought.

    The exceptions to a FFL transfer concerning family members are transfers between spouses or transfers between a parent and child or transfers between grandparent and grandchild.

    Okay, well the plan was to just have her buy it and when we pick it up transfer it in my name. But when she called cabelas, they told her the person it was shipped to would have to be the one having it transferred to them. So she wrote in the comments at checkout at budsgunshop that it was a gift and that it needs to be in my name.

    Well it looks like budgunshop didn't follow her request or they don't read the comments on their orders because cabelas just called her and told her that her firearm was ready for pickup. Its not in my name at all.

    Oh well, it's not too terrible of a mistake it we cant fix it. FFL transfer is 27 dollars.

    $27 is not too bad a transfer fee...some places charge as high as $50.
