Landlord lending me a shotgun
I do not have a license to carry. Can my landlord leave a shotgun at my residence (which he legally owns)? If so, could I use it in case of a breakin?
Thanks

Re: Landlord lending me a shotgun
There is no registration or license required to have a shotgun in your home in the great state of Pennsylvania, as long as you are not prohibited from possessing one.

And that sounds like one awesome landlord...

Re: Landlord lending me a shotgun
Awesome landlord but what is the neighborhood like if the landlord is handing out shotguns with a lease agreement?

Re: Landlord lending me a shotgun
There are actually several different issues here.
Can the landlord lend a shotgun to a non-prohibited adult Pennsylvania resident? Yes.
Can this resident keep a shotgun in his apartment without any licensing, that has no paper trail with his name? Yes.
Can this resident use that shotgun in self-defense? Yes, same as a shotgun that he purchased himself. In fact, the doctrine of justification/necessity would allow even a prohibited person to grab a shotgun in self-defense, as long as he wasn't violating the law by previously keeping it around "just in case". I recall reading a case where a prohibited person was being attacked with lethal force in or near a bar, and someone from the bar tossed him a gun, which he used to defend himself. The charge of "prohibited person in possession" was dismissed, because he only obtained the gun after the threat arose, and because the offense he committed was less than the crime he prevented.
