    Question If someone took off handcuffs while being detained, would it be illegal?

    Just out of curiosity.

    When I say took off, I mean to unlock the handcuffs and give them back to the cop.

    Yes. And if it were me (and it has happened to me) it would get you one of two things:

    1) A canine with no sense of humor sitting next to you ready to eat you
    2) hogtied

    Not to mention the change in status from "detained" to apprehended. I regarded that as an aggressive act, and a threat.

    Probably "resisting arrest"and "attempting to escape" or "elude capture".

    You can be cuffed and be detained while not being arrested...
