    Default (probably) stupid OC question...

    A friend of mine is going to the 2A rally in Harrisburg on Monday. He asked me if he could OC his Mossberg 500 pistol grip shotgun or his Romanian AK-47. AFAIK, it is legal if the barrel is at least 18''. Just need a little reassurance before I give him any advice. Thanks.

    he's good to go as long as he stays 1000 feet away from the schools around the capital.

    he's talking about the rally tomorrow at the state capitol, there are a couple schools that are within 1000 feet of the capitol, so be careful where you go.

    a long gun violates the Gun Free School zone act and will land you in Federal Prison

    Are we still under the State of Emergency declaration from a week or so ago? If so, the LTCF will cover the long gun for the GFSZA..

    18 USC 922 (q)(2)(A):
    It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.
    18 USC 922 (a)(2), (a)(3)(A),(B), (a)(25), (a)(26):
    As used in this chapter—
    (2) The term “interstate or foreign commerce” includes commerce between any place in a State and any place outside of that State, or within any possession of the United States (not including the Canal Zone) or the District of Columbia, but such term does not include commerce between places within the same State but through any place outside of that State. The term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, and the possessions of the United States (not including the Canal Zone).
    (3) The term “firearm” means
    (A) any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive;
    (B) the frame or receiver of any such weapon;
    (25) The term “school zone” means—
    (A) in, or on the grounds of, a public, parochial or private school; or
    (B) within a distance of 1,000 feet from the grounds of a public, parochial or private school.
    (26) The term “school” means a school which provides elementary or secondary education, as determined under State law.

    I really have no idea how Congress thought they had the power under ICC to do this, and PARTICULARLY how they thought they could since the 2A amended the constitution following the ICC grant originally. It's honestly fucktarded.

    I have no idea how the courts have been willing to prosecute on 'that has moved in or that otherwise affects interstate or foreign commerce' without a finding of scienter.

    Pennsylvania's Eastern District courts are still upholding interstate commerce complaints after Heller (but maybe where Heller hasn't been raised?): http://www.paed.uscourts.gov/documen...s/09D1188P.pdf
    even though they clearly knew it existed in 2008

    and 2009

    blah blah blah
    I want to continue going through Lopez and such but it has pained me so much to read what I've read, and what I've read cannot be unread. Maybe later...
