Does the 4th amendment break down when
Hi folks! I am sure almost all the guys here know that cops cant just search your car and home etc without a warrant.... I was told recently by a gun store owner that a game commission officer can just go ahead and check your vehicle even with out a warrant. Is this really the case? He said that if there is a suspicion of "poaching" you dont need a warrant to search ANYBODY'S car. Is this really true. Does the 4th amendment break down when it comes to enforcing poaching laws?

I have a better question: is there any situation left in the USA where the 4th amendment DOES apply?

Steel City is right. Learn the rules and how they apply. Use your internet google-fung and search the exact words of the phrase he supplied.
Or spend some dime and talk to an attorney to know exactly how the 4th Amendment is interpreted in those situations.

Re: Does the 4th amendment break down when
Can you make a post or some sort of list of how it apply's to Pa residents? I would rather read YOUR "unofficial" version than some crap on the internet from a dubious source. I call yours "unofficial" because I don't want people holding YOU liable as you are a cop and it could be misconstrued as legal advice. Lol

Re: Does the 4th amendment break down when
I cannot remember all the details, but there was a case a few years ago where the police used the a GC officer to gain access to a property because the police couldn't/wouldn't get a warrant.
Rules are written in the stone,
Break the rules and you get no bones,
all you get is ridicule, laughter,
and a trip to the house of pain.
