Surely you understand how sensitive of a question this may be to some.

Even Police Officers involved in shootings have their guns taken from them, even if there is NEVER a question of who fired the round(s).
Ballistics tests need to be done, etc.
As far as John Q. goes, yes, it will be taken from you, and it is supposed to only be held as long as the incident is in litigation. Once the trial is over, it should be returned to you, unless, your found guilty of a crime involving the firearm, then, you'll never get it back and it will be destroyed.

If you are talking about defensive shootings (not other "encounters"/issues), then you can expect your firearm to be seized until you are cleared(not charged) or acquitted if charged.

Care to explain why you think it is a "dumb policy"?

It's a piece of evidence, what do you think should happen to it?

in a defensive shooting you saying ya i shot him end of story should be enough. why take your gun too. who know what they will do to it or how u will get it back. after a shooting is when your most likely to need your gun. how about retalliation from the bgs friends etc...

Have more firearms then you have hands. Any other conversation with the police after the fact needs to be done through your lawyer.
