So it sounds to me like if you INTEND to use it as a stock, a form 1/tax must be submitted, but if your intent is to use it as intended, you do not.
Looks like you'll be able to pick one up for under $40 soon.

Sounds to me like it's not illegal to own it or install it on your AR pistol, it's just illegal to put that piece of plastic up to your shoulder. I'm really trying not to laugh at how idiotic that sounds.

And we have only idiots in the gun community to thank for this new ruling. Idiots who think they need to write the ATF outright asking them if the intent of doing illegal things is actually illegal. This was bound to happen sooner or later because some people just cant let a good thing be a good thing.
This is all going to be about intent and nothing more, unless caught by the Feds in the act there is no way to monitor or control the stocks actual use. A good way to cover your ass maybe to use lowers marked "pistol" to show your intent is and was to build a pistol from the start or buy a complete pistol with the brace installed from Sig for $1500.00.Last edited by Hodgie; January 16th, 2015 at 06:56 PM.

That was the last letter. This one addresses it with more certainty (if ridiculously)
The pistol stabilizing brace was neither “designed” nor approved to be used as a shoulder stock, and therefore use as a shoulder stock constitutes a “redesign” of the device because a possessor has changed the very function of the item.

Yup they are now defining it's specific use which in an indirect way is defining how a pistol is to be fired which was something they never did in the past.
