    Default Open Carrying on an ATV???

    Would this be considered concealed? It would be here in the woods I ride my quad in. We have bear that are running all over right now(had a very scary run in with one yesterday), we have all kinds of potentially dangerous critters running around. It is all private but borders state lands.

    i'm sure someone more in the know than I am will respond soon but, I would say that unless your on a public road I don't think you'd have a problem. But it should be absolutely no problem with a LTCF, and your CC'ing.

    If it's your own property, then there's nothing to it - however a quad is still considered a vehicle (at least, in Florida it is and needs to be licensed to rid it in a state park... no experience with PA... yet), so you'd need a LTCF if you wanted to on public lands.

    Standard disclaimers though, IANAL, etc...

    The trouble lies in there is a law about carrying a firearm on an ATV. It must be unloaded. It provides no exception for having a LTC........being a police officer or falling under any other exception.

    § 7727. Additional limitations on operation

    Except as otherwise permitted under Title 34 (relating to game), no person shall:

    (1) Operate or ride in any snowmobile or ATV with any bow and arrows or with any firearm in his possession unless it is unstrung or unloaded.

    (2) Drive or pursue any game or wildlife with a snowmobile or an ATV.

    And there's one you won't find in the ATF compendium of state firearms laws!

    now that law is complete BS, and def. needs attention. So if i'm riding my atv on my land with a loaded firearm its illegal?? I can see hunting scenerios but not all atv's are used for that.

    I was not aware of it either.

    I assume dirt bikes are exempt?

    Further, I own a Kawasaki Mule Trans 4x4. It is considered a UTV rather than ATV, where would that fall? (And I did register and lic. and insure it for the roadway, too)

    If anyone can guess let me know.

    Summary offense. Yeah, pretty stupid law. The law is found in the vehicle code.

    Chapter 77. Snowmobiles and All-Terrain Vehicles (Refs & Annos)

    Subchapter E. Miscellaneous Provisions

    § 7752. Penalties for violation of chapter


    (a) General rule.--Except as provided in subsections (c) and (d) and unless otherwise provided in this chapter, a person who violates this chapter commits a summary offense and shall, upon conviction:

    (1) For a first offense, be sentenced to pay a fine of not less than $50 nor more than $200 and costs of prosecution and, in default of the payment of the fine or costs, shall be imprisoned for not more than ten days.

    (2) For a subsequent offense, be sentenced to pay a fine of not less than $100 nor more than $300 and costs of prosecution and, in default of the payment of the fine or costs, shall be imprisoned for not more than 30 days.
