    Default Ordering a gun on-line Question

    Ok My Girlfriend whom I live with since 1999...( not married, not really common law) wants to buy a pistol..
    Ive found a few deals on sportsmansguide.com With MY membership.... That she may like... Can I place the order to get the discount , have it sent to the FFL in HER Name and She would do the transfer paper work.. Or would that be looked at the same as a straw Purchase ??? not sure what she will end up buying.or where.... but this could be an option if its allowed

    Is it that much for her to have her own membership at sportsmansguide and get her own discount?

    Not saving THAT much after Shipping And transfer.. buying ANOTHER Membership @ $30 = little to no savings lol + we don't need Two memberships..

    That is a tough one and gets debated a lot among FFLs as well. I myself make that decision from situation to situation. I have a friend that I have known for years and they talked about getting his fiance a certain pistol and when the time came he paid for it but she filled out paperwork. I go shooting with them and personally know it is HER gun.

    If it is ordered online I am more apt to let the wife do paperwork for a gun that someone else ordered so long as the person ordering has an LTC and they are there when she picks it up. The spirit of the law is to keep guns out of the hands if people who can't pass a BGC but unfortunately we are not bound by the spirit of the law but the letter of it. And the ATF purposely leaves some language vague so they can pick and choose if, when and who to prosecute.

    Basically if the FFL feel uneasy about any aspect of it they will most likely say no.

    I would recommend calling the FFL that you intend on having receive it and see what they say, the worst they can say is no.

    IANAL, but I would say you're good - the law says you can't straw purchase a gun and give/sell it to anyone else AFTER YOU have passed a background check, the intent being the other person can't pass a check (yes I know there's case law w/ a policeman and both people could have passed). There's nothing that says you can't order it, she pays you back, and then she passes the background check and will retain possession. No hint of a straw purchase in my mind when the intended owner passes the background check.

    Think about it in reverse though: she could be construed as the person making a straw purchase if you've essentially paid for a gun that she is buying, and she were to hand it to you after passing the check, then there might be trouble!

    answer I got from a FFL.....

    If you order the firearm then you must complete the paperwork. ATF rules require the "Actual Buyer" of the firearm to complete the paperwork and background check.

    It was just a thought ...as I was looking at pistols online...Just going to let HER order it when the time comes.. Or pick one out at the LGS... Not that much of a savings to lose sleep over...
