Legal Issue
I'm going through a divorce and my Father has chosen to take my wife's side instead of staying out of it.
An apparent cornerstone of his plan to help my wife and hurt me, was to file a protection from abuse order against me. He was made to look pretty stupid in court and it was dismissed , so that part has a happy ending. However, as part of serving me the PFA, the sheriffs deputies took my pistols and my CCW.
Now the fun part. Getting my shit back from the Northampton Sheriffs.
I call down there and speak with a David something (I'll get his info today). He says "Let me tell you about our procedure for returning weapons" He tells me "To bring a piece of paper from the court saying it's been dismissed." Piece of paper...yeah, ok. I assume he means the Judge's official dismissal. He goes on.."We'll need to run a background check on you" I stop him there. "You come into my house, take my legal weapons and PA issued CCW, all of which required background checks for me to obtain, and now you wont give my property back without a background check?"
He starts screaming "I"m just telling you what our procedures are! I'll keep your damn guns forever, I don't care! Do you want to hear the procedures or not?!"
I tell him that perhaps this matter is best dealt with by my attorney. He screams some expletive and slams the phone down.
So what say the collective? Are these assholes breaking the law? It certainly sounds to me as if they are, at best, taking pretty serious liberties with my rights.

I will check with our evidence guy later today.... we can't return guns either without running the instant background check. Perhaps he can quote the law requiring this.
Marrying a crazy vindictive person sucks! My sympathies.

You should also file a complaint with the sheriff (or have your lawyer do it) for the way the deputy spoke and cursed at you. No excuse for that
