    Angry Friend denied LTCF

    I have a question about a friend being denied an LTCF by PSP. Back in 2002, my friend got into a fight with her husband. He was abusing her. He called Crisis on her because she was talking back, and the a-hole didn't like that. After someone from Crisis came, their argument got worse and my friend threw a chair. The police were called. She was taken to the hospital voluntarily, NOT arrested. She consented to a 72-hour stay in the hospital so that her abusive husband wouldn't 302 her. She was never arrested or adjudicated by a judge, so how could she be denied?

    I suspect more to the story. Something like more to the story on that day or another incident. A plain old error on the part of PSP is possible as well. Best to get the Criminal Access and Review from Harrisburg. Process is easily found with a search but it takes 6 or 9 months for the assholes to let you have the report. Then you can go from there. Others will tell you to call a lawyer but I don't know what a lawyer can do without that himself.

    There is nothing more to the story or anything else to add. I'll look for the report for her.

    The process is easy to track down (been there, done that) but she will have to file it for herself, you cannot request her information. You could gather all of the info for her though and have her finalize it.

    C'mon man, the PSP are the ones who approve or deny the license, the Sheriff just runs the paperwork.

    So your friend wants a LTCF after a history of domestic abuse, assault and being checked int the nuthouse for observations?

    She needs to get a lawyer.....

    Well, the PSP may be a source of info, but they aren't the ones approving or denying - that's on the sheriff.
    But OK, I guess I can see your point.

    All we have to go on is a tiny bit of info provided.
    Is it possible that the denial is based on the "character clause" as opposed to anything to do with an involuntary/voluntary commitment?

    Hard to say with the info we're working with.

    Hard to say with the info we're working with.
    Part of the Sheriff's process is running the PICS check; if PICS denies, that's a hard "no" and the Sheriff is prohibited from issuing the LTCF. It means it's not the character/reputation clause. It's one of the others. And unless there's a drug issue, it means she's also prohibited from purchase/possession of a gun.
