    Newly Introduced Legislation:
    HB 39

    Caltagirone (PN 31) Amends Title 18 (Crimes & Offenses) further providing for cruelty to animals by creating offenses for certain actions against animals, including debarking a dog, docking the tail of a dock over five days old, causing a surgical birth, or cutting off the dewclaw of a dog over five days old. The bill provides for exceptions. Additionally, the bill provides for limited authority of a state dog warden to enforce summary offenses in certain counties in which there is no humane society police officer appointed.

    Perry (PN 32) Amends Titles 18 (Crimes & Offenses) and 42 (Judiciary) further stipulating, in general principles of justification, certain circumstances and situations in which protective and/or deadly force is justified. The bill provides for presumptions of intent, for reasonable belief, for exceptions, for definitions and inconsistencies, and for public officers outlines justifications for the use of force in the performance of duty. (Castle Doctrine)

    Stevenson (PN 48) Amends Title 18 (Crimes and Offenses) further providing for revocation of licenses and for sale or transfer of firearms by stating no seller shall sell or deliver a firearm until the provisions the law have been satisfied. The legislation imposes duties on the Attorney General.

    SB 27

    Washington (PN 11) Amends Title 18 (Crimes and Offenses) providing for a limit on handgun purchases and sales and establishing the Violence Prevention Fund. The legislation would limit individuals to purchasing no more than one handgun within any 30-day period. The bill provides for exceptions, including firearm dealers and collectors, law enforcement agencies or certain individuals whose handgun is stolen or irretrievably lost. The bill provides for penalties and requires fines collected to be deposited in the newly created Violence Prevention Fund. Money in the fund would be appropriated to the Pennsylvania Commission on Crime and Delinquency for purposes of violence prevention and youth violence prevention, including youth education and activities designed to prevent violence and grants to law enforcement agencies for equipment and training designed to prevent gun-related injuries.

    SB 35

    Tartaglione (PN 19) Amends Title 18 (Crimes and Offenses) further providing for mandatory registration of firearms in cities of the first class (Philadelphia). The bill provides for contents of the registration form, confidentiality of information and exemptions for firearms manufactured before 1898, any firearm with a matchlock, flintlock or percussion cap type of ignition system, or certain replicas. No fee may be charged for the registration. In all cases where a firearm is acquired from another person, the person who is transferring title to the firearm must submit to the Pennsylvania State Police, within 48 hours after transferring the firearm, certain information regarding the receiver and the firearm. A transferee must register pursuant to this bill. Also provides for penalties.

    SB 36
    Tartaglione (PN 20) Amends Title 18 (Crimes and Offenses) providing any owner or other person lawfully in possession of a firearm who suffers the loss or theft of a weapon must within 24 hours of the discovery of the loss or theft report the facts and circumstances of the loss or theft to the police department having jurisdiction where the loss or theft occurred. Further provides when a person reports the loss or theft to a police department, the department receiving the report must forward notice of the loss or theft with the information obtained to the Pennsylvania State Police who shall receive, collect and file the information. In addition, the State Police shall cooperate and undertake to furnish or make the information available to all law enforcement agencies in the Commonwealth for the purposes of coordinating law efforts to locate these weapons. Further provides a person who violates the requirement to report the loss or theft commits a summary offense punishable by a fine not to exceed $500.

    SB 96

    Williams, A. (PN 75) Amends Title 18 (Crimes and Offenses) further providing for firearms not to be carried without a license by adding the procedures for which any vehicle or vessel used to transport a person unlawfully carrying a firearm may be deemed contraband and forfeited.

    SB 97

    Williams, A. (PN 76) Amends Title 18 (Crimes and Offenses) providing for purchase of handguns by requiring a handgun purchaser to obtain a permit before purchasing a handgun. The bill provides for eligibility for a permit, which would be issued by the chief of police of a full-time police department of the municipality where the applicant resides or the State Police Commissioner. The bill outlines the application procedure.

    SB 98

    Williams, A. (PN 77) Amends Title 18 (Crimes and Offenses) further providing for licenses by adding that in first class cities (Philadelphia) a license would be issued only if it appears that the applicant has good reason to fear an injury to the applicant's person or property or has any other proper reason for carrying a firearm and that the applicant is a suitable individual to be licensed.

    Anyone else find it ironic that the people who the 1 handgun a month rule was supposedly put in place to stop, will still have no issues. The provision allows for people to purchase more than 1 of your previous firearm was stolen or lost. So you lose or have them stolen and you are still able to go get more.

    Just a note here, a couple of these are Pro-Gun bills. HB 40 is the newly reintroduced Castle Doctrine bill. I applaud Rep. Perry for reintroducing it, although for the time being someone else will have to carry his banner forward. He was just called up and reported to Iraq. He is an Army Helicopter pilot and is now serving our country (for the time being) in another capacity. Another Republican Representative, Rep. Micarelli, is a helicopter doorgunner and was also called to duty. Kudos to both of them for being willing to stand up and fight for our freedom!

    HB 66 is a GREAT bill! This would allow an LTCF to act as an exception to the PICS check. It would save everybody a lot of time and money and avoid all the needless, redundant background checks on law-abiding concealed carry permit holders. Thanks, Rep. Stevenson!

    In general, Screwed!

    It goes back to the "If you have a hammer, everything looks like a nail" principal.

    Representatives/Senators have legislation as a tool, so everything needs more laws to cover it.

    I am beginning to think that our Constitutions have a fundamental flaw. Maybe all legislation should require unanimous consent to pass. (J.K. - sort of ...)

    And if you take note on who and where these supportors arefrom, 90% are from the Philly area. Why can't we the poeple just make them become part of Jersey?

    Would certainly make things a lot simpler.

    Our Constitution isn't flawed, we are, we have allowed them to do this.

    Big Mike,

    Before you get carried away with the posts listed in red, I would suggest you review the bills yourself. Most of them are anti-gun, but I disagree with the poster about HB 66. That is a strong pro-gun bill to allow an LTCF to act as an exception to the PICS check. This is the goal of many of the vibrant Pro-Gun groups in Pa. See the thread specific to HB 66 for more information.
