Question about next of kin sellng a firearm
Hi guys, it's been a couple of years since I posted. My brother and his wife live in CA. His wife's uncle lived near Pittsburgh and just passed away. They are flying out here for the funeral. My brother asked me how the family(his wife's mom) can sell his AK-47 and any other guns he owns to a gunshop. Does the mom(who lives in PA) need his death certificate? While I believe I know the answer I need to be 100% accurate so I can tell the next of kin(my brothers wife's mom) how to sell the firearm to a gunshop and what she will need to bring(IE death certificate etc.). Thanks guys.

Sorry for the loss in your family. The gun shop should be able to answer all those questions for you.
IANAL: But I would think she can just go sell them to the gun shop. I am assuming his wife's mom is immediate family (daughter) and if that is the case nothing is needed. If his wife's mom is a sibling, then it would need to be transferred to her by the uncle's wife/son/daughter.
My response may seem convoluted, but I had trouble reading the description of relatives.Stay armed my friends.

It's not my decision. Their family just wants to take it to a gunshop and sell it there. For clarity, the person who is next of kin is the sister of the person who died. I was not sure if they can just go sell it or if a death certificate is needed.

They will probably need a copy of the will,,,, showing that she is the Executrix and authorized to make decisions for the estate. The Executrix/Executor is the only person that can do anything with the possessions of the deceased. Consult the lawyer that wrote the will. If there was no will,,,,, consult a lawyer,,,, her lawyer,, your lawyer, any lawyer.... IANAL.
