Default Should I report it stolen?

Bought an AR15 from a small sporting goods store. It has problems. It shoots way off, as in I have the rear sight all the way to the left and can't hold center on a paper plate @ 100 yds and hit paper. After 25 or 30 rounds of factory ammo (not steel cased stuff) it won't extract the fired case which of course results in a jam. I take the rifle back to the store and they send it back to the factory. Now for the fun part. It's been 4 MONTHS!!!!!!
I've called the dealer a couple of times and he can't get anywhere with the factory. Finally he gives me the factory's number and I call. I get no answer but left my name & number on the recording. I don't get a return call. A week later I finally have someone answer the phone. I tell her why I'm calling, give her the serial number etc and she says she'll locate the rifle and call me back with the status. It's been a week and I have not received a call. I tried to call again today with no answer.
I'm at a loss as to what course of action I should take.
    Anyone have any suggestions?

Who is the manufacturer of the rifle so we all know who to potentially stay away from.

    Extreme Machining in Grassflats, Pa.
They make AR's and Ak's for American Tactial Imports as well as their own line.

I have been considering writing ATI a letter also.

Contact the BBB and the AG. Ask the AG for help with this issue, as you believe they may have stolen or lost your rifle.

You returned it to the sporting goods store you bought it from, they sent it back and now it's up to you to deal with the factory. BS

I'd be thinking about a road trip,,,, first. Nothing like showing up at their door. The reaction is priceless. (Not that I've done that to these people, but I've done it before to others). And,,,,, DO NOT file a false police report!!!!!!
    George,

The store has been dealing with the factory. I have absolutely no complaints about the store and will patronize the store whenever I'm in the area.
I just got off the phone with them and they are more than willing to provide me with a copy of the paperwork that shows delivery of the rifle to Exteme if I desire it.
I'm really getting upset over this one. Maybe small claims court?

I'd threaten both with BB reporting and if you don't hear anything in a day, file the complaint online at bbb.org. The BBB will know what you've already tried to do to resolve the issue, so it's nice to at least say you gave them some time to respond to your concerns. I've filed complaints on Verizon twice, Comcast once, and Microsoft once, always after months of trying to resolve it myself. In every case a high-level exec with the power to do anything to solve the issue called me to apologize for the terrible service and try to make it right.
