    Montgomery County prosecutors will not file charges against a Norristown resident who gunned down an armed intruder in his home last week.


    “The laws of our Commonwealth provide that citizens of our community may stand their ground and defend themselves inside their homes,” said District Attorney Risa Vetri Ferman on Monday. “Faced with an armed intruder who illegally entered his home, the resident was justified in using deadly force to protect himself.”

    The incident July 28 in the 1100 block of Willow Street resulted in the shooting death of Daryl Marquis Evans, 22, of Cherry Street in Norristown.

    A 29-year-old resident, who lived at the Willow Street address, responded to a knock at the door about 1:27 a.m. However, before opening the door, the resident armed himself with a handgun because of the time, according to authorities.

    When the resident opened the door, he was confronted by a gun-wielding Evans, whom he did not know, authorities said.

    Pointing a gun at the resident’s chest, Evans entered the home and demanded drugs, authorities said.

    Fearing that Evans was about to kill him, the resident pulled his own gun and shot Evans multiple times in the chest, pelvis and leg, authorities said. The resident then called 911 to report the incident.

    Evans was pronounced dead at the scene.

    “The resident acted reasonably and with proper justification when he lawfully stood his ground in his home and used deadly force against Evans during this invasion of the residence,” said Ferman. “The district attorney’s office will take no further action in this matter.”

    Good thing his pistol was registered!




    The killing of an intruder by a Norristown man last week has been ruled a justified shooting, the Montgomery County District Attorney's Office said Monday.

    "The laws of our Commonwealth provide that citizens of our community may stand their ground and defend themselves inside their homes," District Attorney Risa Vetri Ferman said.

    "Faced with an armed intruder who illegally entered his home, the resident was justified in using deadly force to protect himself."

    On July 28 at 1:27 a.m., police went to a home on Willow Street where they found the body of Daryl Marquis Evans, 22, in the living room with gunshot wounds to his chest.

    He was pronounced dead at the scene.

    Investigators said that when the resident, who was not identified, heard a knock on the door, he got his registered .40 caliber, Smith & Wesson semiautomatic handgun, tucked it under his shirt, and went downstairs from the house's second floor.

    He opened the front door and was "confronted by Daryl Marquis Evans, who displayed a handgun," the District Attorney's statement said.

    The resident didn't recognize the intruder, who entered the home with gun drawn. After the intruder pointed a gun at his chest, the statement said, the resident shot six times and struck Evans in his chest, pelvis and a leg. Evans fired his 9mm pistol once inside the home.

    The District Attorney's Office said the resident called 911 after he fired the shots and cooperated with authorities.

    Evans, who lived in Norristown, pleaded guilty in 2009 to aggravated assault, according to a court document. After serving time in a state prison, he was charged in connection with separate matters with intent to deliver a controlled substance, robbery and possession of a controlled substance, the district attorney's statement said. Evans was being sought for missing a court proceeding on those charges when the Norristown incident occurred.

    Yea in most news sources registered = purchased legally.

    Not even sure why there would have been a question of charges not to be filed in this case...

    Yea in most news sources registered = purchased legally.
    There is iron in those words. If you buy a gun in Pennsylvania it is registered with PSP. The phony name they give is Record of Sale but is nothing more than an illegal gun registration.
