RIGHT?!? How the hell is the weapon used to defend yourself in a break in goddamned evidence? Even if they were trying to prove that you shot him (and why would they) they wouldn't need your gun. You have three eye witnesses. I can only imagine the trauma of having to shoot someone who breaks into your home, and then having the cops roll in and start bagging up YOUR stuff. I'd be insane. Makes me slightly enraged just reading about it. Utter nonsense.
When we are involved in a police shooting, our firearm is taken for evidence.

Do you have to jump through the same hoops to get it back?

all you get is ridicule, laughter,

And you are forced to buy another one, or go out on your next shift unarmed, right?
Power always thinks...that it is doing God's service when it is violating all his laws.

The city supplied the first one and since it is a condition of my employment they will supply a replacement firearm.

On duty incident & city firearm, no.

Off duty incident & privately owned firearm, probably.

Update: Papers filed and my hearing is in February.

Any advice on how the hearing goes, or what I'll need to bring?

After 19 months it's finally back!
Spent 3.5 hours running around and waiting today.
Showed up to my hearing on time, sat through the usual BS of other people's cases, DA wrote the wrong property receipt number down so Evidence turned me away, spent another hour trying to find someone to fix the paperwork, waited 30 minutes in Evidence for them to find it and bring it upstairs.
