    Greeley police: August shooting that left 2 dead was self-defense
    No charges will be filed in an August shooting that killed two Aurora men in Greeley, police announced Monday.

    At 5:15 p.m. Aug. 21, Greeley police responded to a report of shots fired in the 700 block of 12th Street. On arrival, police found two men were shot.

    Elijah Joziah Duran, 20, was pronounced dead at the scene just before 5:30 p.m. Aug. 21, according to a news release from the coroner*s office. Deionte Lashay Dior Johnson-Smith, 19, was taken to a hospital with serious injuries. Early the next day, he was pronounced dead.

    Police said the shooting occurred after a disturbance and that it*s unknown whether all parties involved knew each other prior to the shooting. There were several witnesses, according to police. No arrests were made.

    Police have worked closely with the Weld District Attorney*s Office, and both agencies declined criminal charges after reviewing all the evidence.

    *The shooter has an affirmative defense of self-defense,* police wrote in a news release. *A person is allowed to use deadly force if he reasonably believes lesser force is inadequate, and he believes he is in danger of death or great bodily injury.*

    Police: Deadly 11th Street shooting was self-defense

    Springfield Police said the man killed, 29-year-old Willie C. Evans, suffered a fatal gunshot wound by 26-year-old Martin A. Brown as Evans tried to forcibly enter a residence in the 1400 block of North 11th Street. (WICS)
    Police said the fatal shooting that took place on 11th Street earlier this week happened in self-defense.

    Springfield Police said the man killed, 29-year-old Willie C. Evans, suffered a fatal gunshot wound by 26-year-old Martin A. Brown as Evans tried to forcibly enter a residence in the 1400 block of North 11th Street. This happened at approximately 3:30 a.m. on Tuesday, July 7.

    Witnesses told authorities that when Evans arrived at the residence, he repeatedly banged on the door and threatened violence. Witnesses also said Evans went to a bedroom window and forced an air conditioning unit through it to gain entry to the residence.

    At this time, Brown allegedly fired a gun toward the window, striking Evans.

    The Sangamon County State's Attorney said a female resident was also present at the time of the reported forced entry. She is the named victim in a pending felony case against Evans for unlawful violation of an order of protection.

    Under the Illinois Criminal Code, a person is justified in the use of deadly force when the person “reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or another, or the commission of a forcible felony.”

    Due to the circumstances, police said Brown discharged the firearm to prevent the forcible felony of home invasion.

    Additionally, an investigation by the Springfield Police Department indicates that Evans attempted to enter the residence in a "violent, riotous, or tumultuous manner" following threats of violence. Therefore, Brown believed deadly force was necessary to “prevent an assault upon, or offer of personal violence to, him or another then in the dwelling."

    As the result, no additional charges related to this shooting will be filed at this time.

    Brown has been charged with armed habitual criminal, a Class X felony, and unlawful possession of a weapon by a felon, a Class 2 felony. This comes after Brown has been convicted of two forcible felonies: residential burglary in 2012 and aggravated battery (great bodily harm) in 2018.

    Brown was on parole at the time of the shooting.

    Brown turned himself in to Springfield Police on July 7. He remains in custody of the Sangamon County Jail and his bond has been set at $500,000.

    DA: Fatal John Day shooting was in self-defense, initial investigation shows

    No arrests were made in a fatal shooting Tuesday evening in John Day after the initial investigation indicated the shooting was in self-defense.

    According to a press release by Grant County District Attorney Jim Carpenter, the preliminary investigation indicates that Patrick L. Duignan, 34, was harassing Lloyd N. Leach, 86, while Leach was attempting to get from his vehicle to his apartment in the 100 block of Southwest First Avenue in John Day.

    *Leach managed to get into his apartment, closing and locking the door,* Carpenter said in the release. *Thereafter, Duignan forced open the door to Leach*s apartment causing damage to the door and door jam. Duignan rushed down the hallway of the apartment and physically attacked Leach.*

    Carpenter said, during the altercation, Leach fired two shots from a handgun into Duignan, who died on the scene.

    The John Day Police Department, Grant County Sheriff*s Office and Oregon State Police responded quickly to secure the scene after the call came in at about 7 p.m.

    The Oregon State Police major crimes team was activated, and the investigation is ongoing.

    Charges have been dropped against a man accused of killing his girlfriend*s neighbor after he claimed the shooting was in self-defense.

    The Clark County district attorney*s office dismissed the murder charge against Hassan Phillips on Wednesday after Phillips said the shooting was in self-defense, according to Metropolitan Police Department Lt. Ray Spencer.

    Phillips* girlfriend, Mayisha Montgomery, had been charged with harboring or aiding a felony offender, but her charges also were dropped Wednesday.

    Officers were initially called around 8:30 a.m. Jan. 10 to the 4500 block of Carriage Park Drive, near Mountain Vista Street and Vegas Valley Drive, after multiple neighbors called to report a fight and ShotSpotter detected gunshots in the area, Metro Lt. Richard Meyers said at the time.

    Police found a 51-year-old man in the doorway of his apartment suffering from multiple gunshot wounds. He died at the scene, police said.

    The Clark County coroner*s office identified the man as Shawn Swan.

    In a report requesting an arrest warrant, police said the victim was Sean Ryan and alleged that Ryan was in a fight with his upstairs neighbor and former sister-in law, Montgomery, and her new boyfriend, Phillips.

    A loaded handgun was found on the couch near the victim*s body, according to the report.

    Investigators reviewed security footage and spoke to several neighbors, including one who told police Phillips had been in multiple arguments with the victim recently over rent payments, because he subleased the upstairs apartment to Montgomery and Phillips.

    Phone records for Phillips and Montgomery showed the pair leaving Las Vegas on Jan. 14 and heading to Aurora, Colorado, according to the report. Montgomery*s cellphone information showed she returned to Las Vegas but that Phillips* phone had not left Colorado as of Jan. 29.

    *He was located and arrested on the warrant in Denver Colorado,* Spencer said in a message to the Review-Journal. *After his arrest we were able to interview him and he made a claim of self defense. As a result of his interview and details that he provided the district attorney decided to dismiss the charges based on the his self-defense claims that were consistent with evidence at the scene.*

    Man dies after shooting in north San Angelo, incident marked as act of self-defense

    SAN ANGELO — The San Angelo Police Department is investigating a homicide that occurred Tuesday afternoon at the Cheyenne Crossing Apartments, after a man was found in the road suffering from a gunshot wound.

    Police were dispatched to 17 West 31St. just after 2:30 p.m. Tuesday, Feb. 9, 2021, for the report of a shooting victim. Officers learned that the alleged female suspect had fled the scene on foot, according to a news release.

    Responding officers located the man lying in the parking lot of the complex, suffering from an apparent gunshot wound to the torso.

    He was transported to Shannon Medical Center by ambulance but succumbed to his injuries. He was identified as 51-year-old Roy Perez Sr. of San Angelo.

    The alleged suspect was located by officers at West 32nd and Grape Creek Road and taken into custody without incident. The woman, a 23-year-old San Angelo resident, was transported to the Department’s Criminal Investigations Division Annex Office for a formal interview.

    "Several witnesses and residents were also located and interviewed during the lengthy field investigation and a discarded firearm was located near the scene by Police Service Dog Xander," the release states.

    The preliminary investigation revealed the woman saw Perez assaulting another male at the property just before the shooting.

    "When the woman attempted to intervene, Perez pursued her with a knife and the woman shot Perez in an apparent act of self-defense," according to the release. "In conjunction with the District Attorney’s Office, it was decided that no charges would be filed at this time."

    This is an ongoing investigation and no other information is available for release.

    DA details investigation of deadly Wolf Creek self defense shooting
    WOLF CREEK, Ore. * A newly released report from the Josephine County District Attorney's office describes an inexplicable exchange of gunfire on a Wolf Creek property in early April that left one man dead.

    The DA's statement details the conclusions of an investigation into the deadly shooting. On the morning of April 2, 29-year-old Preston Sweaney drove onto the property of Jerry Seibert on Speaker Road near Wolf Creek. Seibert and another tenant were there talking when they suddenly heard gunshots.


    According to the DA's office, Seibert grabbed a rifle and went out to investigate the sounds of gunfire. As he walked down the driveway, several shots flew his direction.

    Seibert fired two shots in return. He later told investigators that he thought the second shot hit the person in the vehicle * later identified as Sweaney. Seibert then went back up the driveway and called 911.

    "Seibert did not know the vehicle and it does not appear Seibert knew Sweaney," the DA's office said.

    When law enforcement arrived on the scene, they searched Sweaney's vehicle * finding a rifle in his lap, a pistol and shotgun in the passenger seat, alongside cash and methamphetamine.

    Sweaney was later identified by the Josephine County Sheriff's Office, using his tattoos for comparison.

    Other witnesses in the area backed up Seibert's account of events. The DA's office said that evidence both on the scene and gathered via an autopsy showed that Sweaney had been shot in the left side through his driver's side door, but that he had also shot himself in the lower side of his face.

    "In a situation where self-defense is used, the reasonableness of the person*s use of self-defense must be disproven by the State beyond a reasonable doubt," the DA's office said. "Based on the totality of the circumstances that occurred on April 2, 2020, the reasonableness of Mr. Seibert*s actions to use deadly force to protect himself and others based what occurred on his property * an unknown person in an unknown vehicle on Seibert*s property, firing a weapon multiple times, and fires a weapon at Seibert as he is coming down the driveway are all factors in the reasonableness of Seibert*s use of deadly force."

    The DA's office concluded that the state would not be able to disprove self-defense beyond a reasonable doubt, prompting them to not press charges. It also noted that use of force is always analyzed on a case-by-case basis.

    "In each case involving the use of self-defense, a fact specific inquiry into the reasonableness of the use of self-defense must be made to determine if such actions are justified under Oregon law," the DA's office said.

    EBRSO: Pregnant woman killed boyfriend in self-defense

    One killed in shooting on Hanks Drive, one in custody
    BATON ROUGE, La. (WAFB) - Deputies say a pregnant woman shot and killed her boyfriend during an altercation.

    According to the East Baton Rouge Parish Sheriff’s Office, the incident happened on Wednesday, Jan. 13 at roughly 4 a.m. It happened at a home located on Hanks Drive.

    Investigators believe Terrell Worthy, 26, assaulted the woman. She reportedly pulled out a gun and shot him in the chest.

    At this time the woman is not facing charges. The case is being classified as a justifiable homicide.

    Man fatally shot in apparent case of self-defense in Moreno Valley

    In an apparent case of self-defense, a man was fatally shot during a family disturbance in Moreno Valley on Sunday morning, officials said.

    Deputies arrived at 1:15 a.m. to a home in the 23700 block of Blackbird Circle to a report of a family altercation, the Riverside County Sheriff*s Department said.

    *An estranged family (member) arrived at the location and broke into the residence while threatening to cause harm to the occupants,* a sheriff*s statement said. *The occupants confronted the estranged family member who became hostile. During the altercation, a resident used a firearm against the assailant.*

    Deputies found Cesar Acosta, 43, of Moreno Valley suffering from a gunshot wound. He was taken by paramedics to a hospital, where he was later pronounced dead.

    *At this point, the shooting appears to have been done in self-defense,* the sheriff*s statement said.

    Christmas Day shooting viewed as self-defense

    On Christmas Day at approximately 2:11 p.m. Dent County deputies responded to a call that someone had been shot and was taken to Salem Memorial District Hospital. The shooting victim was reported as 35-year-old Cody Givens.

    Major Pabin said that upon arrival at the hospital the doctor handed him a bullet and told him that Givens was lucky. The bullet, a small caliber round, had passed through the lower-left side of Givens’ abdomen, through his pelvis, somehow missing vital organs and exiting cleanly from the upper portion of his left buttock, ultimately getting caught in Givens’ clothing.

    Pabin said that upon investigation the timeline of the day was Cody Givens arrived at 30-year-old Kayla Richardson’s private residence, wanting to see his child for Christmas. Richardson and 34-year old Blake Wood were present.

    When his child was apparently not there, Givens got angry and left. Givens drove to a private residence in Salem where he believed his child to be. There he got into a physical altercation before heading back to Richardson’s private residence. Around this time, Richardson was driving her vehicle the opposite direction. Pabin said that according to Richardson, Givens swerved into her lane upon recognizing her vehicle.

    Richardson called Wood, who was still at her residence, letting him know that Givens was on his way back.

    Upon arriving, Givens got out of his vehicle brandishing a tire-iron. Blake Wood then shot Cody Givens.

    Dent County Prosecuting Attorney Andrew Curley told The Salem News that he is “aware of the incident, however, no probable cause statement has been submitted by law enforcement.” Pabin said that initially they had approached it as a possible attempted murder; however, upon closer investigation they determined that Wood had acted in self-defense.

    County D.A. says Baldwin shooting was self-defense

    The fatal shooting involving B.J. Baldwin in Las Vegas last month was a *clear case of self-defense*, according to Clark County District Attorney Steve Wolfson.

    According to reports in the Las Vegas Review-Journal, Baldwin and his girlfriend Tori Nonaka were sitting in their vehicle in the parking lot of a restaurant at around 2:00am on April 22 when two men approached them. An altercation broke out, and 18 rounds of gunfire were exchanged. Josef Smith, 43, was killed, and Smith*s brother Kevin, aged 40, ran from the scene and was later arrested. Neither Baldwin, who is trained in firearm protection and had a concealed weapon permit, nor Nonaka were injured.

    A police report cited in the Review-Journal stated that the elder of the Smith brothers had become agitated after an unsuccessful attempt to purchase a gun from a store in the complex earlier in the day. The brothers noticed Baldwin and Nonaka in their vehicle when they returned to the area later. Kevin Smith later told police that his brother had instigated the shootout, and that Baldwin had acted in self-defense and should not be charged.

    Smith faces charges of conspiracy to commit robbery, attempted robbery and assault with a deadly weapon.

    Baldwin is a two-time winner of the Baja 1000 and drives the Baldwin Motorsports No.97 Monster Energy/Toyo Tire Toyota Trophy Truck in major desert-racing events.
