I really do not think we are hearing the whole story. I would submit that it's impossible to break a cane off of someone. It is definitely impossible to break it over someones bottom.
If she kept the smacks to her bottom, and no where else, can you really argue malicious assault?
I do not believe that the cane broke only over this girls behind.

If I had the choice between receiving a beating vs. having a standing felony charge, I would choose the beating.

I have never hit my kids with my open hand.. I feel like I'm too big to do such a thing. However, when they were younger, I used a thin belt on each of them once. That is all it took. They understood there was a line they could never cross. A thin belt stings but does not do bodily harm like I feared my hand would. My kids are straight A students who don't act like disrespectful idiots as some children I have seen.
A cane is way over the top in my opinion. If it's anything like the canes I have seen, it would take a tremendous amount of force to break it over someone.Last edited by Pector55; June 22nd, 2008 at 10:37 PM.

Perhaps by "Cane" they were using it in the same way we would say "switch"
Still very hard to break but thinner than the walking cane. However, the thinner the item, the more it hurts and can lacerate.

Wow.... that guy means business. I think he might treat his dog better than his children. What children need today is to respect, and be responsible. If you beat some kid like that, you might end up with your head blown off. Just like the Melendez boys. It is legal in PA to spank your child with your open hand. ANY foreign object is a no-no. If your child is 16 years old, 250lbs and attacks you as a man would, you may detain him until the police can be called. You may not kick his ass. If he gets the best of you, you can charge him with assault only if he threw the first blow.* Don't ask me how I know.
I don't believe in beating a kid, but a busted ass works wonders.
*This information was accurate as of 18 months ago, IIRC. I'm sure any attorneys here will correct me if I'm wrong or if this has changed.
As for the two girls, forgive me, but "Girls just want to have fun", Cyndi Lauper. I say let 'em, nobody is going to get pregnant.
