AK Open / Conceal Carry Question

I believe the firearms that fit within those PA legal descriptions are NFA weapons, called short barreled rifles, short barreled shotguns and machineguns. Those must be registered with the NFA and require a $200.00 tax transfer stamp, background check, fingerprints and LEO signoff. (unless corporation purchase)

Ak's and such firearms have specific rules that have to be adhered to to keep them legal. But if its legal to spec. you could technically walk around with it.

I know i get nervous even going to the range with mine, its 100% legal... but id hate to get pulled over with it in the car.

An AK that's title 1 compliant will have all of these features:

• Barrel 16" or longer
• Self-loader only/no full-auto
• Fixed stock

is under the same law as any other rifle. If it has no buttstock but isn't a machinegun, the barrel can be almost any length as it's classified as a handgun.

If the AK has any one of these:

• A barrel under 16 with a buttstock
• Fires more than one shot for each pull of the trigger

It's title II, or a National Firearms Act weapon.

If the AK has a folding stock that can make the gun under 26" overall length, it may be considered a "firearm" in the pistol context. But, that shouldn't make any difference to a person that open carries a handgun anyway.

I'd be more concerned about proving that the correct percentage of parts are in it to be 922 compliant. Until recently, a lot of US parts weren't marked US-made. For a pre-1989 AK, it's a non-issue.

Sec. 478.39 Assembly of semiautomatic rifles or shotguns.

(a) No person shall assemble a semiautomatic rifle or any shotgun
using more than 10 of the imported parts listed in paragraph (c) of this
section if the assembled firearm is prohibited from importation under
section 925(d)(3) as not being particularly suitable for or readily
adaptable to sporting purposes.
(b) The provisions of this section shall not apply to:
(1) The assembly of such rifle or shotgun for sale or distribution
by a licensed manufacturer to the United States or any department or
agency thereof or to any State or any department, agency, or political
subdivision thereof; or
(2) The assembly of such rifle or shotgun for the purposes of
testing or experimentation authorized by the Director under the
provisions of Sec. 478.151; or
(3) The repair of any rifle or shotgun which had been imported into
or assembled in the United States prior to November 30, 1990, or the
replacement of any part of such firearm.
(c) For purposes of this section, the term imported parts are:
(1) Frames, receivers, receiver castings, forgings or stampings
(2) Barrels
(3) Barrel extensions
(4) Mounting blocks (trunions)
(5) Muzzle attachments
(6) Bolts
(7) Bolt carriers
(8) Operating rods
(9) Gas pistons
(10) Trigger housings
(11) Triggers
(12) Hammers
(13) Sears
(14) Disconnectors
(15) Buttstocks
(16) Pistol grips
(17) Forearms, handguards
(18) Magazine bodies
(19) Followers
(20) Floorplates

I believe this is illegal.

However, even if it is legal expect extreme consequences. I have learned from my experiences to trust no one but yourself and your higher power.

You cannot hope to exercise this legal right, (if it is a legal right), without significant legal consequences.

We no longer live in a free country, and between the police and the sheeple you WILL be prosecuted to the full extent of their imagination.

Please, from on firearm owner to another, don't try anything bold b/c they WILL railroad you.

How many times are these types of threads gonna come up? You know we have a search feature. I usually hate saying that, but not as much as I dislike these type threads. Why would you carry an AK or AR down the street any way? I know the OP here said he did not plan on doing so, but....Just seems like a silly question and it keeps popping up.

This post is meant mostly in jest, however...

--I would OC my carbine because it is my right to do so.

--Why do I carry? I would feel more comfortable if I could have my attorney present before answering any more questions.

--I carry the carbine because it will act as a deterrent. If I was in a bank that is about to be robbed, the person OCing a Glock may become a target, but with an AR slung on my chest, I am sure the would-be thief would surely reconsider.

--I would OC the rifle because it is tactically sound. The rifle has far more stopping power than a pistol. Why should I sacrifice my safety by relying on a pistol when I can carry a weapon with serious stopping power?

--I have much more training with a rifle than with a pistol, I would prefer to carry a weapon that I am more competent in using.

--I carry the carbine in an effort to educate others about our 2A rights. (I'm working on a flier!)[not really]

--Oh yeah, and don't let me forget the most important reason: I OC my AR because I have a tiny little weenie that my gun helps me make up for.

Okay, so on one hand I am joking, but really... The same reasons that we think OCing a rifle is silly include many of the same reasons that the antis think that OCing a pistol is silly. Seems worth considering.

If you buy or build an AK/AR pistol. You could carry that with your LTCF... But if you ever had to use it... You would get thrown under the bus in court.

I didn't know that. If it is classified as a handgun then I guess you could carry it loaded in the car/vehicle right?
