    The new city ordinance is a flagrant violation of the state preemption statute. They will of course claim they have the authority because bump stocks aren't firearms, but the law also specifically prohibits auto sears without any exemption for those lawfully owned under the NFA. Drop in auto sears are firearms under federal law.

    They can *say* bump stocks are banned all they want. But it wouldn*t hold up in court! The Supreme Court has ruled them LEGAL. And they are LEGAL in Pennsylvania. Because of this, a person in Philadelphia who purchases a bump stock CAN NOT be prosecuted. It like them trying to BAN LTCF in Philadelphia. (Which they TRIED to do & FAILED!)

    Philadelphia tries these things with 2A rights whenever they get a chance. Problem is Philadelphia thinks of itself as the Law Maker in Pennsyltucky. But, unfortunately for their egos, Philadelphia is held to the laws of the commonwealth of PA under Pennsylvania government. If you have a bump stock in Philadelphia & we*re harasses, arrested, etc., you would have a clear lawsuit & get a nice payday on behalf of the City. (Of which I*m ALL for wasting Philadelphia Tax Dollars! It*s nothing but DEMONcrat Libtards & I live in the suburbs.)

    SCOTUS didn't rule them legal. SCOTUS ruled against the ATF's ability to define them as machine guns given the authorized written definition of a machine gun by Congress. ...thus removing the prohibition on them that the ATF artificially made.

    Congress, the states, and municipalities can prohibit them with proper law. Now, what calls into question is whether PA's preemption covers the bump stocks.

    Correct. My apologies. I realize the Supreme Court does not deem things Legal or Illegal or make law* not their roll. Thank you for correcting.

    My point was that Philadelphia does not have the right to undermine the State. Which is what the topic of the thread. Oh, and to be clear* I think bump stocks are one of the most retarded accessories ever made for a firearm! I never wanted one when they were first released or anytime since! However, I believe it was WRONG for President Trump to speak against them & try to outlaw them, just as I*m against the *AFT* trying to outlaw anything! It*s the only thing I really saw major fault with him doing.
