    Default Private Sales out of State??

    I can imagine this has been asked before but I am having difficulty finding the thread or threads that address this.

    I am a PA resident with a PA drivers license. If I find a hand gun for sale out of state (OH, W.VA, MD, NY, NJ). Could I drive to the other state (OH, etc) and purchase a handgun from a private seller and do the transfer at an FFL in the other state (OH, etc.)?

    I am finding guns that I am interested in that are worth the drive for me but have never purchased a handgun or any firearm out of the great state of PA.

    Thanks for any info...or links that could answer my question

    I believe the handgun has to be transferred at a FFL in your residing state(Pa).

    Any options to ship to your FFL?

    No. The handgun must be shipped and transferred to you via a PA ffl

    What is the law on long guns?

    You can buy long guns out of state, but they must go through an FFL. Also, the seller can bring the gun to PA, and have an FFL do the transfer here. Either way, you have to go though an FFL for all out of state transfers.

    There is no law saying it has to be shipped, it simply has to be transferred to you at an FFL in your state of residence. Just for clarity, someone could bring their handgun to an FFL in PA to sell to you.

    Q: From whom may an unlicensed person acquire a firearm under the GCA?

    A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

    [18 U.S.C. 922(a)(3) and (5), 922(b)(3), 27 CFR 478.29 and 478.30]


    Important to note that the term "firearm" referenced herein only pertains to those defined in the law (i.e. Handguns) Rifles and shotguns are identified individually.

    Long guns can be purchased in any state providing the Licensed Dealer in that state wishes to sell to an out of state resident. They are not obligated, although most will.

    If you are selling to an out of state person, they can meet you in PA at an FFL, you can meet them in their home state at an FFL, doesn't matter. But a dealer transfer (4473) must take place.

    Handguns can be PURCHASED in any state, but must be transferred via a dealer in the buyers home state.

    Long guns may be shipped USPS while handguns must be shipped via expedited carrier (FedEx) one day shipping or "overnight" I do believe.
