Seriously the fact that there are even people debating these things is ridiculous when we should really be debating the best way to go about ending BATF altogether.
Fuckin A. Unelected bureaucrats have no business "interpreting" laws.

It's called the "administrative state". It's doing exactly what it is intended to do, control the citizens by using bureaucratic administration with the elected officials hiding behind rules and regulation designed to confuse and hamper freedom. Then they appoint Judges to uphold words that were never written.

You'll find no argument there from me. I am only pointing out that you can't have your cake and eat it. If you want pistols with braces, then the ATF is going to make sure that "braces" are signifcantly different than "stocks". The minute a stupid manufacturer tries to make both out of the same molds, well here you go. SB and Q should have known better.
As far as I'm concerned, the only thing that makes any sense at all with regards to this issue is to split semi automatic firearms into two groups: "concealable" and "non-concealable", with the likely determining factor being the longest dimension of the firearm.

So under this would a 8.5" 300blk with SB PDW brace be illegal? Asking for a friend?

I do see what you meant. Since there is shitty legislation (the NFA) on the books and it would take an act of Congress to change that, then I do 'appreciate' (please sir may I have some more ) the distinction between large format pistols and SBRs.

I'd like to see the law bestowing ATF with the power to enact laws and the power to enforce them?
