Technically yes, but not in a way that makes a difference. This makes it seem like we shouldn't be concerned. That moron Brayden over at Langley Outdoors Academy made everybody think there is nothing the Democrats can do and they have no power to do anything that matters. Nothing could be further from the truth.

ATF just got a radical new anti-gun director and marching orders to go ban/regulate "concealable assault style weapons", 80% and homemade firearms, etc. Of course they are going to do it enthusiastically. If "shall not be infringed" didn't stop them, the word "action" instead of "order" isn't going to stop them either.

I accepted a long time ago that the politicians of this country would make me a felon eventually.

I agree. The teeth of the Constitution is our right to keep and bear arms. That was the purpose- to oppose a tyrannical government destructive of its own ends.

Would a PAFOA lawyer please explain why the following would not apply to the coming gun law changes? The below should apply to E.O.'s enacted by the President also.

I'm not a lawyer, but I think they get away with it by making a distinction between punishing a prior act (e.g. anyone who has ever eaten a doughnut prior to this date is guilty of a felony) and a future (or continued) act (e.g. anyone found in possession of an unserialized doughnut after the effective date of this act is guilty of a felony).

Of course, I think there are arguments against this from a "takings clause" perspective (depriving someone of use of their lawfully-owned property by rendering it illegal), and in the case of firearms, the obvious 2nd Amendment violations.

But I think this is how they get away with it.

ETA: I'm not sure if or how they can compel you to take some sort of action to remain in "compliance" with such an act. For example, requiring someone to go serialize all of the doughnuts they already have in their possession or pay a doughnut tax stamp would be costly and might not be able to be done before the effective date of the act. This also seems like it should be illegal, since they are compelling you to take some action to remain legal. It certainly seems unfair and unethical, but that doesn't seem to stop anyone.
