Background checks for handguns?
I know when buying a handgun (new or used) in Pa. you have to go through a FFL. I always thought it was like in every state but I just watched a documentary and in Arizona the people bought 3 used handguns and no background checks were done. So my question is, was that at all legal? Are there states that you can really buy a used handgun with no checks being made?
Re: Background checks for handguns?
Yes depends on state law.

Yes. My understanding is that PA is in the minority with the "duty of seller" thing. Most do not.

Yea its legal in other states, I've been to gunshows in other states and have seen it in person
Re: Background checks for handguns?
In some states, anyone can buy just about anything legally.
Re: Background checks for handguns?
As a 29 year resident of Arizona[the Mississippi of the Southwest], I can assure you that you can buy just about anything there without ANY paperwork or questions. I bought a number of firearms from private individuals without any questions, including at gun shows. Of course, Arizona is a constitutional carry state, where you can carry concealed WITHOUT a permit. The Wild, Wild West is still alive in AZ!
Re: Background checks for handguns?
In Fla it is legal to sell a firearm without going to a ffl. But that would not allow a person from a different state to purchase a handgun without going thru a ffl. Of course this the law, so there are exemptions.
1. Military exemption - most common
2. Students in out of state schools with the correct age
3. Home owners in two states. legal but difficult to do. FFL's reluctant to accept out state id. Fed govt does not want people to have two different ids from two different states.
But then in FLA there is no open carry. Different states different gun laws.
Re: Background checks for handguns?
Virginia also allows person-to-person sales of used long guns and hand guns without a FFL as long as both are residents of Virginia and not prohibited.
Re: Background checks for handguns?
It's been many years ago but I've bought and sold with just a bill of sale in Kentucky and believe it or not, Maryland.
Re: Background checks for handguns?
There are numerous states that allow private transfer of handguns among residents like Pa does with long guns. The ATF doesn't control that....yet.
