Wilson Borough Proposes Lost & Stolen and The Evolution Of Proposal
Another lost or stolen ordinance proposal. However, what's really interesting is the evolution of the proposal found in the council's meeting minutes (below). Particularly the meeting on 4/12/10. In this meeting they discuss the legalities of the ordinance and how if enough townships pass the law, the State will be forced to adapt.
NOTICE NOTICE IS HEREBY GIVEN that on May 10, 2010 at 7:00 p.m. in the Council Chambers of the Guy B. Tomaino Building, 2040 Hay Terrace, Wilson Borough, Pennsylvania, the Borough Council will act on proposed Ordinance No. 751 (of which this notice is a summary). Said Ordinance requires notification to authorities of lost or stolen handguns within 72 hours after discovery of the loss or theft, imposing penalties for violation, and providing that the ordinance shall take effect on July 1, 2010.

Mr. Feinberg recently met with various Mayors in the Lehigh Valley concerning the passage of an ordinance on the straw purchases of handguns. Allentown, Philadelphia and Pittsburgh have already passed similar ordinances, but the state has not done so as yet. Mr. Feinberg would like to have Mr. Minotti write a similar ordinance for the Borough to pass. Motion by Mr. Reiss to authorize Mr. Minotti to draw up the ordinance. Second by Mr. Starniri.

Mr. Minotti had prepared a copy of the draft ordinance regarding lost or stolen handguns. Mr. Lacheman, Pennsylvania Coordinator for Mayors Against Illegal Guns, was present to answer questions about the proposed ordinance. Mrs. Lilly-Kemmerer stated that she had received an email stated that the legislation was illegal. Mr. Lacheman responded that several municipalities had enacted similar ordinances throughout the state. Several of the municipalities had similar demographics to Wilson Borough. The law has been challenged twice and both the laws were upheld. The matter has been appealed to the Pennsylvania Supreme Court. A decision has not yet been made. It is felt that if enough municipalities enact an ordinance regarding lost or stolen handguns, the Commonwealth will follow suit. The only firearms mentioned in the ordinance are handguns. The ordinance warrants reporting of the handguns within 72 hours of discovery. The ordinance is not a total solution, but may help in alleviating straw purchases.

Mr. Minotti has reviewed the information received at the last meeting concerning hand guns. He does not see any reason that the Borough cannot pass an ordinance. Mr. Minotti will prepare the ordinance to be enacted on July 1, 2010. Motion by Mr. Feinberg to authorize the ordinance to be advertised for the next meeting. Second by Mr. Jones.

Yep Aylinsky 101....overwhelm the system. How did all these Progressives get in power everywhere ya look? A minority but in charge. FUBAR!

You see, what needs to happen is that for every one of these illegal ordinances that pass, there needs to be municipalities that pass COUNTER ordinances. Use the same tactics as them, but in our own favor.

This is exactly where organized meetings at the county level with people from each town would come in handy.
We need to be organized.
I know it can be time consuming, but it needs to be done.
We need to be proactive in showing people the truth, the law, and who we are.
Mayors against Illegal Guns, and Cease Fire are groups that will get the boros in trouble and ultimately cost us more money to:
A) Defend ourselves
B) Municipal money when they get sued because they have no right to make these types of law according to the state.
How can you go backwards to get a law enacted?
Makes no sense and it is a misdemeanor against the law.

I think we should follow MAG's example, SWAMP the system. But we do it within the framework of the law, not outside. First, one, five, ten, twenty effected private citizens go to the DA, ensure to notify members of the press. use sound bites like "these mayors demand their subjects follow the law but they like to flaunt it", and file private citizen criminal complaints against all parties who wrote, sponsored endorsed and voted for these illegal ordinances. Mind you this is x number of individual complaints, not x number of people signing on to the same complaint. Next said individuals MUST file a complaint with the PA Bar association for EVERY Lawyer/ solicitor/ attorney involved for ethical and legal violations of the Bar, get as many of them as possible disbarred for their unlawful activities and conspiracies. Make it PUBLIC as the day is long, but it must be by people with standing, and it must be more than just the "Local gun nut".
