    Default NJ Shall Issue

    I just found this bill in the NJ Legislature:

    Looks like not only will remove the "need justification"...but if I'm reading it correctly will make NJ shall issue...?

    SB 69 Page 10 Line 26:

    Requirements for the issuance of a 26
    permit. A permit to carry a handgun shall be issued by the chief 27
    police officer of the municipality in which the applicant resides or 28
    the superintendent, as the case may be, if the applicant is not 29
    subject to any of the disabilities set forth in subsection c. of 30
    N.J.S.2C:58-3 and if the following additional requirements are 31
    satisfied:

    That is a nice swing. The new republican Governor (forgot his name) seems to be worth something.

    The only problem I see is his DA background. They could be a little stiff on this issue. Or not.

    Anyway, I have my fingers crossed. Can't wait to get my NJ non-res permit myself

    Im right here. I wouldnt hold your breath on this actually seeing the light of day anytime soon. A "shall issue" bill has come up every year for at least the last ten or so. After having a sit down with the Senate President back in February and trying to get him to see that a bankrupt NJ is on the verge of a tsunami of lawsuits once McDonald v Chicago comes down, and how much easier and more affordable it would be for everyone ( even the nongun owners are sick of the Legislature wasting money ) to start re writing the nonsense laws , in order to avoid lawsuits they cant possibly win, Im hopeful, but still fully expecting to have to drag the State kicking and screaming through the Courts to affect any real substantial changes.

    Dont forget, the new AG still supports the " collectivist theory " of the 2A , which even the Brady Bunch has abandoned. Christie also ran for County Freeholder at least partially on supporting the NJ AWB.

    The fact of the matter is NJ is in such piss poor shape financially tha firearms laws are the LAST thing on anyone's minds, even the taxpayers. As far as Im concerned , NJ is the Titanic. At this point , the damage and flooding are so bad, sinking is inevitable and all that is left is to abandon ship as quickly as possible.

    Look at all the flack Christie is catching over the budget cuts. And next year will only be worse, cause next years budget gap is 11 BILLION !

    I saw an interview with Christie a while back (probably via a link on PAFOA where he said he was not in favor of "shall issue" carry for NJ.

    Maybe he's come to grips with reality or got a face full or party pressure and therefore changed his tune, but I wouldn't be surprised at all if he vetoed this even in the unlikely event that it did pass.

    Guys, I'll throw a huge party for the PAFOA if this gets signed into law!!! Fingers crossed....... Christie never outright said he'd be anti-shall issue, rather, that the state assembly would never let it see the light of day. Who knows? I'm waiting for the Mc Donald case to force the hand, and I just love the fact that the bankrupt state would be forced to defend a myriad of lawsuits defending shall issue, and open/concealed carry. Where I do find a problem is, that issuance will still be in the hands of the local police chief. The municipalities should have absolutely nothing to do with issuance. It should be handled uniformly, on a county level.

    If you want to laugh, I was discussing shall carry in NJ with a retired Port Authority Lieutenant. His exact words were that: " NJ will never have concealed carry, because the state is the most densely populated in the nation, and the "PBA WOULD NEVER ALLOW IT"." He looked at me kind of funny when I politely informed him that the state Patrolmen's Benevolent Association has no legal authority in this matter, and can only offer opinion. See, that's the type of LEO attitude that is pervasive in NJ. I'm not knocking all LEO's in NJ, but there is a mindset that a lot of them think they are above the common folk, and only they deserve the priviledge of concealed off duty carry, or retired carry. I've even been questioned by off duty NJ cops in gun stores when I was buying holsters for carry. They ask me if I'm a LEO, and when I tell them no, they look perplexed as to why I'd even be buying a holster. One LEO even went as far as to ask me if I had a NJ Permit To Carry. I politely informed him that it was none of his business. You'd have thought he was going to have a coronary. When passed, it is not going to go over too well in the counties that have cities, but that's too bad. NJ has suffered long enough at the hands of the corrupt, anti-gun politicians, and now it's time to take back the state. Pray for us.

    The whole "dense population and amateur citizens would end up missing and killing other citizens because they don't know how to handle a gun/will be shaking too hard to aim properly" is pretty popular with city cops./
