Re: Open carry confusion
Could you provide a location for this? I have been told by several hunters that I know and trust that carrying a sidearm during deer season is illegal. Because I trust him, I take him at his word, but if I challenge him, I'd like to have documentation, specifically pertaining to possessing a sidearm (loaded or unloaded) on State Game lands.
The PGC website is a brutal mess to surf.

Re: Open carry confusion
your friend was right up until the end of last year/beginning of this year.
prior to that it was illegal to carry a semi-auto pistol while hunting even if you had an LTCF. however, that law was changed at the end of last year and went into effect early this year.
here is a link to the text of the bill:
http://www.acslpa.org/n-legislative/HB%202563.htm
here is a link referencing when it was passed and signed into law:
http://www.nraila.org/Legislation/Read.aspx?ID=2503
(it became effective 60 days after it was signed into law on 12/08/06).

Re: Open carry confusion
If you are talking about carrying during archery seasons, etc. That was a recent PA State Act that has just gone into effect. The law was passed after the digest was printed. In the past you could not carry while hunting.

Re: Open carry confusion
I think I need to clarify this. You are not allowed to drive around with a handgun in your vehicle without a License to Carry Firearms. There are some exceptions, but they are narrow, for direct travel between your home and the gun range, for direct travel to and from the gun shop for repair or sale, and a few others. It's only within those exceptions that it matters whether the weapon is unloaded and separated from the ammo. If you are not within an exception, it's not a defense that the gun was unloaded, or even that it was unfireable.
There have been successful prosecutions for individuals who carried the stripped frame of a handgun in a vehicle, without ammunition. The frame is the gun. The statute doesn't require that your carry poses any risk to anyone, or that it could do the things that guns do. If the serialized part is in the vehicle, and you don't have a license or an exception, you're guilty.

Re: Open carry confusion
I have a PDF copy of the PGC Hunter's Safety Book.
I downloaded it from their website here.
But like Red said, it is in the digest. Or click on the 'General Hunting Regulations' link on the page I listed above.

From this years PGC Digest:
http://www.pgc.state.pa.us/pgc/lib/p...07/updates.pdf
"All hunters and spotlighters who have a License to Carry Firearms Permit can now carry firearms, but only those authorized by the permit, which are defined in Title 18, Section 6102 of the Crimes Code. (Most sporting
arms are not authorized.)"

Re: Open carry confusion
Whilst reading this thread I just thought of something.
SAy I don't have my LTCF (which of course I do 'cause all the cool kids are doin it) but I'm not prohibitted.
So I become an OCer.
I would have no way to LEGALLY go anywhere unless I walk.
The law says I can only carry a handgun in the car (unloaded) to or from my house, gun shop, shooting range, fixed place of business.
If I am running into town to run errands i can't legally have my gun unloaded in the car, load it when I get there, walk around town OCing, unload the gun, get in the car and go home.
Is this correct?Adams County Sport Handgunners Association - President
