But you may be arrested for failure to provide ID (verbal or document) if they can't (establish identity)

If someone calls for a MWAG...points to me....and I am asked for ID....I have a feeling cops aren't going to say "Ah, let him go, he won't talk"

    ?

I am very curious about this too

I always assumed you had to identify yourself verbally (Name, DOB and address), but ONLY if detained/arrested. But if the cop did tell me that I WAS detained or arrested for something.... my next words would be "lawyer" anyways. So IMHO, I will never need to provide anything to an officer, unless driving, caught CC'ing, etc.s

Based upon what statutory requirement to provide it?

Just typing my thoughts out here...

Non-detained, Non-arrested: You do not need to provide.
    Traffic stop = detained

detained/arrested: You also do not NEED to provide it, hell you don't need to say anything.

    right?

ok, but, can an officer arrest you simply for not being able to establish your identify while engaged in an investigative action (responding to MWAG)

If not.... can I just stand there EVEN when detained and choose to not identify myself verabaly?

Let's not lead people down the wrong path. How are you caught carrying concealed? If someone sees your firearm, you continue with what you were doing just as you were before. If your jacket blows open for the entire world to see what is hidden under it, you're now open carrying... which is legal.

So, there is no 'caught' in this sense especially if you read 'caught' as found out that you were doing something wrong/illegal.

Can you all please help me understand something?
I'm just about as pro 2A as anyone else but I have a hard time understanding why, if someone is not doing anything wrong, why they would have a problem providing LE with their ID and LTCF if asked to do so.

If you're pro 2A then you already know the true intent of the 2A.

You will often hear that allowing law enforcement to demand your ID randomly is extending their reach into our lives and privacy. It's not hard for me to see that requests for, 'Your papers, please.' go hand in hand with an overly powerful controlling government. Just as the 2A was written to limit government to the consent of the governed there are/should be limits on where 'to protect and to serve' start and stop.

Demands for my ID when I've done nothing wrong and there is no RAS, is only letting them encroach even closer to the line in the sand.

Because some of us wish to actually exercise the liberties we have, which are recognized in our founding documents. Anyone is free to not exercise those liberties as well, if that is their preference.
