So it looks like that should cover me from the airport to my friend's house.
Interestingly enough, I could OC it on my person during the car ride from the airport to my friend's house, but we would have to avoid school zones like the black plague.
Yea, I'm debating even attempting to OC since it is such a pain in the ass... plus I'd need to get a OWB holster and a speedloader... plus I will likely be hassled by LE.Last edited by uniballin; March 13th, 2010 at 01:50 AM.

LOL I always thought in CA you wouldn't have one in the chamber. So could you OC your gun empty, then keep a mag in another pocket?

There is a case law from the 70's that states that the mag has to be displayed openly as well... lol.

Hello,
I lived in California for five years and routinely flew back and forth with a pistol between Pennslyvania and LAX.
My understanding of the law is, you are allowed to possess your firearm in the state for 60 days before having to register it with the CADOJ, as they classify you as a "personal handgun importer."
This 60 day exemption is in place to protect new residents to the state, however statutory law isn't specific to that effect. I used this so-called "loop-hole" often in my travels.
Flying with a handgun into California is no different than any other state that is lax about firearms entering their state. I check my handgun at my airport of departure, fly into California, and pick up my bag from baggage claim just like anyone else. No red flags, no statements at my point of arrival, nothing.
I would dare to say they would never even know you are bringing the gun in in the first place, but in case you do come into any problems while you are there, all you need to tell them is you are establishing residency in California and have 60 days to register your handgun.
"I am moving into California and I own several handguns. What are the new-resident registration requirements?
You are considered to be a personal handgun importer as defined by California law. You may bring all of your otherwise California-legal firearms with you, but you must report all of your handguns to the DOJ within 60 days as required utilizing the New Resident Handgun Ownership Report. [PDF 518 kb / 2 pg] You are not required to report rifles or shotguns. You may not bring ammunition feeding devices with a capacity greater than ten rounds, machineguns, or assault weapons into California.

"California Penal Code section 12025 does not prevent a citizen of the United States over 18 years of age who is not lawfully prohibited from firearm possession, and who resides or is temporarily in California, from transporting by motor vehicle any pistol, revolver, or other firearm capable of being concealed upon the person provided the firearm is unloaded and stored in a locked container.
The term "locked container" means a secure container which is fully enclosed and locked by a padlock, key lock, combination lock, or similar locking device. This includes the trunk of a motor vehicle, but does not include the utility or glove compartment. For more information, refer to California Penal Code Section 12026.1."
I would highly suggest you do not unloaded open carry as a non-resident in California, especially if you have not established residency or cannot readily prove that you are in the process of establishing residency.
While there are no specific laws about non-residents unloaded open carrying firearms, I can likely see them challenging you on the matter.Open Carry: it's whats for dinner.

yes you can bring it, and once you land and are in in CA, you must transport it, unloaded, and in a locked container (a locking pistol case IS acceptable, and the ammo CAN be in the same container, just not in the weapon.)
you can technically OC wan unloaded weapon, but i wouldnt because Kalifornians are Kommunist, so there would probably be an incident. but if you do, you may carry the ammo in a magazine and in your pocket.
when i go to CA (every other week or so) i bring my weapon with me and leave it locked up in the car, or in my friends place, because thats the best i can do.
