ok customloaded im not on here to make enemies and im not a young punk. like you have imaged in your stereotypical head. i was miss treated in the army and opted to be discharged after my tour in Afghanistan. My marijuana charge from when i was 15 was actually paraphernalia and i was escorting a case of beer in a backpack to a friends house witch was 21. that was the only trouble i was ever in and as far as drinking and driving goes I would never get behind the wheel after drinking and I am a very responsible person. So if your not going to give me answers to my posted question and bash me then get off my post. for the previously asked questions i will post a scanned copy

Then, you go onto say, and seem to be quite proud of a General discharge as Character of Service while employed by The United State Government ie The US Army. General discharge? Hmm, why not HONORABLE? Seems whatever you did under 18, carried over past the age of 18. One thing about most miltiary branches, don't care what you did before hand, only what you do while in the service. Guess you dicked that chance up too?

If you came up HOT on a urine test while in the Armed Forces and did not get a medical clearance waiver from a doctor because you were on prescription medical, ie still smokin weed, you should be prohibited from owning any firearm, especially since any UMCJ action/conviction for drug use is a felony, much less a LTCF.

I don't know how old you are now but if you are under 25, I think you ought not to be able to have LTCF until you are 35 years old. And during the ten years prior to age 35, be completely clean, not even a parking ticket. Then, you might be of such character to be considered for a LTCF.

I'm well (enough) aware of the law in PA regarding LTCF and weapon ownership. I have no intention of starting a marijuana/underage drinking debate, and I will not say what side I'm on either way. Your life is not worth any more than this guy's life, and he should have a right to protect his own. The law is against him, fine. That's not going to change on this snowy afternoon. Your attitude and opinion need some reconsideration. Or keep thinking the way you do, I couldn't really care less. Way to go on 'casting the first stone.'

I would have to agree with you, You are the DICK in the bunch, Your response or attack on the OP is the reason why people donít stick around here. You know nothing about this OP, Yet you go on a rant questioning his Integrity. For all we know the OP may very well be a law abiding citizen wrongfully denied an LTCF, But thanks to post like yours we probably won't find out just what kind of person or contributions he could have made to our community. To the OP most people here are very helpful and you will find answers here, This is a good place to be for Gun owners.

I think it was a dick move for the sheriff to send out a denial letter as soon as he heard you were placed in research (assuming that is what has occurred, as otherwise there's little point to its mention 'undetermined' in the denial letter.) The PSP has to resolve that status in 15 days so they ARE going to call your sheriff back. If he gets a unique id number for the check, what is he going to do then? Nothing, even though you're eligible?

Character or fitness can be determined by the Sheriff regardless of the statuatory applicability of any specifc charge in regards to a denial. Chrages and convictions evidencing habitual drinking along with a drug charge/conviction is not good for an LTCF...
Fitness has long since been thrown out the window, maybe around 1995 when we got something that more closely represents our 18 Pa.C.S. 6109 today. The law no longer provides sheriffs with some sort of "I don't feel like it" power and even 6109(e)(1)(i) is much more stringent than for apparently what even sheriffs and CCP judges give it credit. The phrase is 'character and reputation' as the manner of proof of a likelihood to act in a manner dangerous to public safety, and simply could not be satisifed by a docket or a PSP PATCH printout, or even a police report.

"is an unlawful user [of marijuana]" has been found, in its federal equivalent at 18 USC 922(g)(3), to mean contemporaneous use in the course of use of firearms. See United States v. Augustin, 376 F.3d 135 (3rd Cir. 2004).

'Underage drinking' as a charge does not differentiation between simple imbibing of an inebriant (creating no or ANY level of BAC), drunkenness, possession, or transportation of liquor or malt beverage. Even police reports describing true facts of drunkenness, two times for a person anywhere from the age of 0 to 18 and in the lack of charges for 3 years since (being at least 21 to apply for LTCF) is an impossible case for a 'habitual drunkard'. Neither the word 'habitual' nor 'drunkard' ought to be given some relaxed standard of construction than what they deserve.

Guess I'm the dick of the bunch. You were under 18 and were only CAUGHT underage drinking TWICE and only caught with marijuanna ONCE. How many times were you not caught? If anyone wants to know what an anti shill planted into the depths of gun nuts looks like, I present you customloaded. Worse yet is that he is employed by our tyrants. Do we really want someone who believes in guilt before proven innocence. . .someone who believes in calling government punishment on people based on their shallow opinions. . .someone who believes that the LTCF should even exist...as someone who attempts to control us?

Then, you go onto say, and seem to be quite proud of a General discharge as Character of Service while employed by The United State Government ie The US Army. General discharge? Hmm, why not HONORABLE?
I have limited knowledge of the complete discharge system of the US military, but I'm sure there are reasonable examples of not-honorable-but-not-dishonorable-that-aren't-general-under-less-than-honorable discharges, one example I think that may have come up elsewhere on PAFOA regarding entry level separation or something close to it. I doubt they give out HD's for entry level separation, but they do have to call it something, when they Army just doesn't want you that much but there's no actionable conduct on the part of the dischargee, don't they? If you unilaterally don't want to complete your contract with the Army, too bad. If they don't want to complete the contract with you, apparently they can opt for such a type of general discharge.

Good point. That magical LTCF might allow him to carry a gun like real criminals do. And like everybody else without LTCF does. ANYBODY can carry a gun. Don't mean to impugn your LTCF Alma Matar.
