    Question 40mm White Phosphorus Rounds

    I was just curious if its legal to be in possession of live 40mm WP Parachute rounds?

    I cant find anything on the net.

    Good question. I don't thing WP in itself is illegal, neither are flares as far as I know, but I am not the person you want to base legal advice on, especially a possible DD or AOW.

    Anxiously awaiting somone 'in the know'....

    Weren't 40mm launchers ruled to be Destructive Devices? But the 37mm's weren't so long as you use gas, pyrotechnic, and flare loads only? ...I'm almost certain of it.

    As a side note the WP does not stand for white phosphorus it stands for white parachute flare. Bright ass white flare suspended by a small parachute. I saw 40mm white phosphorus in the title and thought, how in the heck can you get those....and why? But the parachute flare....why not!

    I believe you are correct. 40mm ammo in itself is not illegal to own, but a 40mm launcher is ruled as a destructive device, since "destructive" rounds are attributed to it. The 37mm launcher, does not have any grenades/destructive ammo attributed to it, therefore, there is practically no regulation. I think the only ammo you can get for the 37mm is flares, bags, and a shotgun adapter... however, I think there may be regulation on the adapter since it then turns into a "destructive device" IIRC...

    *Remember, IANAL,an ATF agent, and I do not know for sure... this is just from my memory alone... take it for what it's worth.

    Thank s for everyone's help.
    I think Im going to just sell my 40mm rounds.

    Getting a DD 40mm tube looks like far too much money and work for my interests.

    Get a 37mm launcher,then register that as a DD. You are likely to save big bucks that way. I know I was planning to do that with mine, but I lost interest and have been looking to sell my launcher. Then you can reload your own DD type rounds legally, everything but the HE ones at least.

    Thats a good idea, but the problem is, I got case of 40mm rounds sitting in my kitchen closet collecting dust.
