YORK, Pa. -- A man cleaning a handgun in York accidentally shot his 3-year-old son in the back, according to police.
It happened Wednesday afternoon in the family's home on the 500 block of Jessop Place.
Police say the wound was not life threatening.
Police also said the father, Reinaldo Vargas-Santana, is not expected to be charged.

I've never seen a (non-muzzle loading) gun that can be effectively cleaned while in-battery, much less with a round in the chamber.
Cleaning seems to mean "dicking around with," these days.Any mission, any conditions, any foe at any range.
Twice the mayhem, triple the force.
Ten times the action, total hardcore.

How do you clean a loaded gun? I never figured it out.
The round in the chamber seems to block the cleaning rod, what should I do?

"Cleaning accidents" have been the standard "stupid mistake" for decades. It's easy and difficult to disprove. "Why were you handling the gun?" "I was getting ready to clean it."
It could have been the standard semi-auto mistake: rack the slide, drop the mag, boom!
Ask any large police department how often that happened after they switched to semi-autos.

He should be charged with negligence......stupidity is not accidental, its negligent. guns don't accidentally go off and shoot a child. if nothing else, it should have been pointed in a safe direction away from the child.

I may get smacked for this, but it's worth it.
This guy needs to lose his guns and go to jail. There is NO excuse or circumstance that would have me handling a loaded weapon with kids around, especially toddlers. Holstered or locked or some other SAFE situation - but handling it????? NFW!!!!!
I've said it before and say it again - CLEANING has become an excepted PC excuse for ND's and WE are allowing it to happen. Even thinking about handling that gun for a minute and this would not have happened. I don't know what he was doing but "dicking" with it, or showing off, or CUTTING CORNERS by not making the area safe, come to mind. This is WRONG and should be punished, period.

How can the father not be charged with anything? Owning firearms comes with great responsibility and this guy obviously should re-evaluate whether or not he should own any considering he doesn't exercise any common sense to make sure the firearm is UNLOADED!!!
1. Treat the firearm as if it is always loaded
2. Make sure the chamber is cleared
3. Never put your finger on the trigger unless you're going to fire the firearm (except when dry firing in a safe direction)
