    Default Pistol Transfer

    OK heres my situation. A guy i used to work with went to prison about 4 years ago. His family is pretty much selling everything he has owned. How is it that I can buy a pistol that is registered to him if he is in prison, or is that not possible?

    Well then how would I transfer it into my name? I have to do that don't I, I mean I just cant go and start buying all of his pistols right!? What needs to be done?

    There are no guns "in your name", as there is no registration in Pa.

    Handguns generally must go through an FFL (for PICS check, etc).

    The seller delivers (via mail, in person, 3rd party) to FFL, you do paperwork/PICS and take home.

    Have his spouse/parent/grandparent/child/grandchild sell them to you (with his permission of course). Transfers between the above mentioned parties require no paperwork, and when you go to transfer the pistols to yourself, it doesn't matter who the last "buyer of record" is.

    If they guy has been in prison for four years already, he can't lawfully own the firearms, so hypothetically, they may already be the property of one of the excepted family members I noted (or at least should be).

    Agreed that the current lawful owner can have them delivered to an FFL through a variety of methods.

    Here inlies my problem..... Family no longer talks to him and hes a 25-lifer. The family has done everything but change their name so they have nothing to do with him and I have no way to contact him. I know they have no problem selling them to me but I didnt know if he would have to do/ sign anything. Ive never bought a pistol off of a private party thats why im asking.

    As noted above, the length of his sentence indicates he can no longer legally own the firearms anyway. He may however have a lawful claim on the proceeds of the sale of these arms, but that's a matter for the family to deal with, not you.

    Get them to a dealer, fill out the paperwork, and take them home. Let the family deal with their own drama. I can't see how the guy in prison can claim theft of items he can't legally own in the first place. Doing so would set him up for additional charges for each firearm involved.
