    Default Sale ? to out of state

    I have a person that wants to buy a ar from me. They are out of state and would like to meet FTF, i have no problem doing that. I just do not know if the firearm has to be transfered to the buyer or if like our long gun sales go for ftf.

    I think its ok for an FTF like any other long gun sale but i am not sure, does anyone know for sure?

    I'm pretty sure the sale has to meet the legal requirements of the purchaser's home state of residence.

    If the buyer resides in another state I believe it has to be transferred.

    Federal law requires all interstate long-gun sales go through an FFL. You can utilize an FFL in either state.

    thats funny i just got off the phone with a local dealer and they said it was ok, i questioned it as everyother firearm i sent went to a dealer so why wouldnt this have to be transfered as well.

    My usual dealer is closed today but i sent him a email just to double check.

    Oh it is, i like it so much i decided to part with my other one. The sad thing is i have only had it out once since i got it from you.

    Glad to hear it!...I saw your other one listed on here. I'm still heart broken that I never got to shoot it but it's not like I can never get another one in the future. Good luck with it and I'm glad you at least got to shoot it that day, better than it sitting in my closet. They're made to be fired!

    Your local dealer either misunderstood your question or is completely ignorant.

    Q: From whom may an unlicensed person acquire a firearm under the GCA?

    A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee’s premises in any State, provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides. A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

    The place i called is not my usual place of business, and actually i do not like them at all but they have sunday hours so i called, its going to be transfered.

    DO NOT LISTEN TO THIS PERSON, HE IS WRONG. Any and all interstate transfers of any guns must go through a FFL. In the case of a handgun it must go through a FFL in the buyers state. In the case of a long gun it can go though a FFL in the buyers state or the sellers state.

    Per BATFE:
