    Talking Remember my thread about getting a ticket for OCing an empty holster ? Court Tonite

    Remember my thread from Thanksgiving weekend over being stopped by Police for OC'ing an empty holster ?

    Well , I finally had my day in Court tonite and the verdict was .................................................. .................................................. .................................................. .................................................. ..




















    NOT GUILTY /CASE DISMISSED !





    I held palavar with the Prosecutor before Court actually started. He started to go down the bully path, but I stopped that nonsense in its tracks when I made it clear I wasnt intimidated , wasnt copping a plea , wasnt backing down an inch and his pursuit of this matter would result in allegations by me of serious potential 1st and 4th Ammendment Violations by the officer during cross examination. That really got his attention, I dont think he ever heard someone say something like that over what seemed on the surface to be a simple and routine traffic/parking ticket. He still thought I was bluffing until I read choice pieces of my transcript of events to him. Including the fact that NO ONE from the Store or Customers complained to the Officer about me, that Store Security tapes would show that the Officer never approached me in a manner that would support the Officer actually believing I was armed in any fashion, that the Officers first words to me werent FREEZE , or HOLD IT , or STOP RIGHT THERE , they were " thats really stupid isnt it "

    When I mentioned the Officer stopped me on foot in the parking lot ,that the radio call logs would support that he called it in as a pedestrian stop on foot in the parking lot, in violation of the mandates of Terry v Ohio and Brown v Texas and that the Officer himself admitted that what I was doing when he initiated contact with me wasnt in itself illegal ; and that the Officer would have to admit this under cross during trial , or risk perjuring himself, he started to crumble. He started stammering and I swear I could see smoke starting to wisp out from his ears and it was pretty clear at this point he was just blustering in an attempt to save face. I delivered the coupe' de grace by informing the able Prosecutor that even if we went to trial and I somehow was still found guilty , that I would file for an immediate appeal to the Superior Court and then file a 1983 Claim in US District Ct against the Officer and the Township for violations of my 1st and 4th Ammendment Rights and further I would pursue charges and sanctions against the Officer for official oppression under the color of authority , and whatever other Civil Rights violations I could come up with.


    With that he visibly deflated , let out a sigh, turned to me and say's , if I dismiss this outright , will you just go away ??

    Done and Done I said !

    OASN , He did approach me while I was in the galley waiting to go in front of the Judge for the official dismissal and asked me where I had learned all that stuff and if I had ever went to law school , which I took as a pretty nice compliment.

    Tonight was one more small victory, proving that a regular Joe/Jane, that takes the time to know their stuff and has the moxy to stand up and fight can in fact take on " The Man " and win one! Felt GREAT !!!!

    Hard to believe there is actually some sanity in NJ, of course, it was only because the "state" was confronted by someone who knew what they were talking about. The average Joe would be shit out of luck.

    LOL , nah , I wasnt about to walk into the lions den with a big piece of meat hanging on my hip , but I did have it with me as an exhibit if needed and even wore the same clothes as that night just in case I had to demonstrate how it looked or how visible/invisible it was.
