    Default Storing Firearms

Is it legal in Pa to store firearms for a friend? I have friend who is moving and asked if i could store a few pieces for him? Just wondering if this is legal or not? Also if these firearms were stolen from my house (not that anybody could) what level of liability will I be accounted for?

    Thanks in Advance!

    IANAL IANAL IANAL

I think that as long as the person doing the storing is not a prohibited person, and there are no other occupants that are prohibited persons, it's okay.

There may be issues, however - I don't know for sure.

Are these handguns or long guns? I could be wrong, but I believe it makes a difference. IANAL

Edit: You may want to check out 18 Pa.C.S. § 6115: Loans on, or lending or giving firearms prohibited. It is available in the library. I believe this is the section you want to take a look at.

Do you have a LTCF [license to carry firearms]?

If you have a LTCF, your friend may legally lend you firearms (as defined in §6102 - basically, handguns and NFA stuff). See §6115 regarding loans / lending firearms.

Long guns are not defined as firearms as long as they exceed the length requirements in the 6102 definition. In that case he can give/lend you the long guns even if you don't have a LTCF, provided you're not prohibited.

I am not a lawyer. I encourage you to do further research.

Is there some reason that he can't have the guns at his new residence?

EDIT: Welcome to the forum. Check out http://reference.pafoa.org/statutes/ to read the statutes for yourself. It's a great resource, you'll learn a lot!

A little more info: I do not have a license to carry. Yes they are all pistols. And finnaly my friend is going to a period of time between moves where he will be staying at relatives house who does not want him to bring the firearms into the home. They have kids and are not comfortable with the idea of having guns in the home.

I am not a PA lawyer, so this is just my personal opinion.

    You have three choices here:

    1. Get one,
    2. Adopt him, or visa versa (because it's legal to transfer to/from your parents),
    3. Don't do it.

You could, in theory, have him transfer them to you through an FFL, and then transfer them back, but that will get VERY expensive (about $20+ per gun, each way), a lot more expensive than getting a LTCF.

I think that because they are pistols you have 2 options:

    1. Get your LTCF, and have him "lend" you the guns
    2. Have him transfer via a FFL/Sheriff the guns to you. When he is back where he can take possession of the guns, transfer them back to him.

Your best bet is to get the LTCF. There's really no reason not to. I'm sure others can give you details on the specifics for Bucks County.

I concur with the majority. Just get your LTCF. It isn't expensive, it's easy to do (for the most part) and it will come in handy many more times than this. Stay legal and get the license. Best of Luck to you.

IANAL but i think in section 6115 of PA's UFA there are some exceptions for lending or loaning. The way I read it, agian IANAL, If they are kept within your home your ok. Is there a lawyer that could elaborate??
