    Default Need some facts.

Here is the situation: Applied for a ccw license and was denied due to a restraining order from 7 years ago filed in NJ, with my ex-wife. Fast forward to present day...Ex-wife is removing the restraining order on 2/5/2010.
I was told by PA. state police to show proof this is removed, then can be issued a ccw license.
Does anyone know this to be true?
I was never convicted of Domestic Violence or any violence for that matter.
The restraining order was put in place originally as a temporary order, so she could have my weapons removed from our residence.
It then somehow turned into a permanent order when the divorce was finalized.(bad attorney).
I hope i supplied enough information to get accurate responses.
    Thank you.

Why 2/5/2010? Thats a pretty specific date.

Who from the state police told you this? The state police do not issue a LTCF.

Pa. does not issue a CCW. They issue a LTCF, License to carry firearms.

1-Apparently, the restraining order has an expiration date.

2-Although the state police do not issue LTCF, they are contacted by the Sheriff office during the process, basically they do a pics check.

3-Potato/potatoe, here in PA it's LTCF...in some places they call it a CCW...it means the same thing.

He says the wife is removing it. Not that it is expiring.

He also says that the sate police told him. Not that he went to the sheriff and was denied.

Nope. A LTCF is required in several circumstances even if the firearm is NOT concealed. Also, some states that issue "concealed weapons permits" allow the bearer to carry a variety of implements that can be used for self-defense that they would not otherwise be permitted to carry. PA's LTCF applies to firearms only, and thus is appropriately named, and not synonymous with a "concealed weapons permit".

As you can see, it covers things other than CC.

The expiration date is listed on the order. If the date is not listed on the order the order will expire in 3 or 5 years, depending on the type of order.
It will however be visible on your record for a long long time if not forever. Your ex might try to lift it but you will have a hard time getting it off of your record. I suggest a good lawyer to get all that done.
