Friend's stepdad denied LTCF Allegheny county
A friend of mine at work told me his step dad was denied a LTCF by Allegheny county due to having filed a false medical claim awhile back. He ended up getting an attorney and it went to court today. My friend went as a character witnesss and I will know tomorrow what the outcome was. I was a little suprised by this as I thought shall issue meant as long as you meet the requirements to own/buy/possess a firearm, you would be granted a LTCF.

I'm not saying it's a correct decision, but they will probably try to justify the denial under this language, which is a pretty broad catch-all for denying licenses to anyone who ever did anything "wrong" in their life:
" A license shall not be issued to any of the following:
(i) An individual whose character and reputation is such that the individual would be likely to act in a manner dangerous to public safety."Almost a LIB .... ertarian

When will these Sheriff's learn that it's possible to have "bad character" or a "bad reputation" and still not be a danger to the public, which is the statutory requirement. Insurance fraud (even if true), may make you a slug, but it does not make you a danger to the public.
I predict a win.

filing a false medical claim is fraud. fraud is a kind of larceny, just like stealing a car.
i vote no liscense.

First of all, we do not know the WHOLE story.
Second of all, even if this is the truth, and he DID indeed file a false claim. And EVEN if for ONE second I agree with you that a false med claim is the same as grand theft auto,WHICH IT IS NOT, can you show me where in that old piece of worthless tissue called the CONSTITUTION it says that those who have stolen are excluded from the second admendment.
Last I checked, even if your charged with rape, you do not lose your 1st admendment, freedom of speech. . . .
Why do you lose the 2nd, right to bear arms???????

I found all of this out at the end of the day yesterday and today was court so I will get more information tomorrow to give you all an update.
I don't know all the details surrounding the fraudulent claim and it is not my business to ask the circumstances but that is the reason he was given for the denial.

insurance fraud punishments are usually nothing to sneeze at, it wouldn't surprise me if it was because he fell into the "individual who is charged with or has been convicted of a crime punishable by imprisonment for a term exceeding one year;".
IANAL, but I don't think you need to actually get over a year in prison, just convicted of a crime that could have a prison term of one year+.

Is there a P.S. section that says these admendments do not apply to felons??
Do you lose your freedom of speech if your convicted of a felony???
Why are states able regulate one admendment but not the other?????
If you are convited of murder, does that mean you no longer have the right to a speedy trial?????

Have to agree with you, even though I think rapists should be hung in the town square, no matter what crime you have committed your rights should be fully restored after you have paid your debt to society. If you are still considered a threat then you should still be in prison.
