Default PA to MD - gun transfer ...

    Guys,

I have someone from MD interested in my AR - when I say from MD that is his home address. He works in Pennsylvania, not that it matters, but thats how he found out about my gun.

My question is can I legally sell him my AR face to face? I know if he was a PA resident I could, but since he's from MD does this now make it a no-no. Something tells me yes, that if he wants to buy it we would need to transfer it at a FFL.

    Any help?

    Thanks.

There really isn't a such thing as an interstate FTF because you need a FFL to complete the transfer.

The AR must be legal in his home state of MD, which I think it is. Hi-cap mag restrictions apply, so if MD has a restriction he might not be able to get/take those(not sure of MD's mag laws).

I dont think MD requires any license/permit/registration/FOID type nonsense for long guns - so, you can do a transfer at a FFL in PA or in MD. The gun MUST go through a FFL because it is an interstate transfer.

knight has it correct. What you need to do is to have him check the MD laws to see what they say about buying a long arm (and maybe in particular an AR) in a neighboring state. For example, if the person is from NJ and wants to buy a long arm in PA, they still have to get the NJ firearms purchase permit. Since I don't have the MD laws in front of me, I don't know what their requirements are.

MD also has different laws regarding hi-cap magazines.
