PA gun law question - Revolver
Hello Guys, new member here, great site, glad to be aboard.
I have a question and hope I’m posting in the correct section.
I am a PA resident temporarily working in FL over the last two months and will end the assignment in another month or so. I will be coming home for the holidays and returning to FL one more time.
While in FL I made a deal with one of my co-workers for him to buy my Colt Diamondback revolver. He is a FL resident.
I would like to bring the gun with me to FL in January and do the transaction there. He was told by a FL gun shop that there will be no problems for him to buy an out of state gun.
My question is what am I required to do here in PA before I take the gun out of state to sell (the gun is registered in PA). My main desire is to get the gun out of my name with the PA firearm department. His FFL told him they will not be contacting anyone in PA after the transaction.
Is there a form I need to fill out? Hoping I do not have to deal with PA gun shop or have them ship the gun to FL.
Thanks!!!!!!

Re: PA gun law question - Revolver
As far as I know there is no problem in what you describe. By you taking a pistol to Florida and selling it to a Florida resident via an FFL you are good to go.
Since there is no gun registration here in PA you do not have to do anything paperwork wise. Just follow the airline (if you are flying) rules for taking the weapon in your checked baggage and you are good to go.Join the groups protecting your rights from the fools trying to take them from you!

Re: PA gun law question - Revolver
So long as it goes through a FFL in Florida to complete the transfer to the FL resident, and you get it there in a lawful manner, there's no problem.

Re: PA gun law question - Revolver
Knight and Steve , I hope your both mentioning the part about completing the sale thru a Florida FFL ONLY for the purposes the OP stated about wanting to get it " out of his name " . I lived in Florida from 2003 to 2006 and unless the law changed in the last couple years, there is NO requirement to use an FFL to purchase a pistol face to face if your a Florida Resident. The OP could just as easily be driving an entire inherited private collection down there to one of the gun shows. As a private transaction , no FFL need be involved . Since PA doesnt maintain a " gun registry " all the OP has to do is legally transport the weapon to Florida and sell it to his buddy ( again provided the buddy is an actual Florida resident )

Re: PA gun law question - Revolver
Its due to federal law on interstate transfers. Florida's FL resident-to-resident transactions remain the same as you describe. With the OP being a PA resident, and the purchaser being a FL resident - its an interstate transfer. So the firearm must go through a FL FFL.

There is no "registration" in Pennsylvania
ref: 18.Pa.C.S.6111.4

Complete the transfer at a FL.FFL (to comply with Fed law) and you're done._________________________________________

Re: PA gun law question - Revolver
Thanks guys for the great information.
From the sound of things the real focus is on the buyer before the transaction (to make sure he/she is legally able to own the gun) and not much if any focus on the owner/gun after the sale is completed.
However I did receive a copy of the “Pennsylvania State Police, Application/Record of Sale" document (SP 4-113) when I first bought the gun and I assumed that data was at least entered into some kind of database and once I did not have ownership of this recorded gun that the database should be updated.
I just wanted to make sure once I sell the gun, my liability ends.

Re: PA gun law question - Revolver
I know your new , but you have LOTS of reading to catch up on . That form and the practices of the State Police and their ILLEGAL" Gun Registration Data Base thats Not really a Database" are notorious and legendary around here.
Your spot on in your first paragraph , generally speaking , much greater focus is paid to the prospective buyer then to the seller , unless the seller is doing such a volume of transactions that he's skirting the ATF's definition of being a dealer without a license or is otherwised barred by law from owning , touching a gun etc.
That being said , its generally considerded to be a good idea to draft up a Bill of Sale on your PC , including things like a description of the weapon , color , barrel length , revolver , semi auto , rifle , shotgun , etc , the weapons serial number , any other unique identifying features etc. Also get at least minimal buyers information , name , address , maybe drivers license number if they'll give it to you ( many wont ) and date of sale. Have both of you sign it and keep your copy in a safe place. It will be a BIG help in defending yourself if a decade down the road the firearm in question winds being used illicitly. You dont need to give this Bill of Sale to ANYONE other then you and the buyer , unless you need to prove at some point you no longer own the weapon.Si vis pacem, para bellum

+1 about that last post.
Maybe PA doesn't require registry but, if you remember the paperwork that you did when you bought the pistol and the telephone call that the dealer made before completing the sale - somewhere there is a record of that gun with your name and address attached to it. You want to make sure that that connection is erased when you sell the gun.
