You guys lost me. So does it make sense for this case to test the "other lawful purposes" clause in the PA law?

We're still lacking details, but from what I have read I'd say this seems like a pretty sane case. Looks like the defendant was peacefully attending a class in a "school building", blabbed his mouth more than he should have, and the PD freaked out and arrested him.
I really hope this man doesn't lose his right to bear arms over this...
If I were his lawyer I'd try to plea this down a tad, as fighting it is a massive hassle..

If I were to play attorney, my first move would be to try and get this pled down. This would also be my desire if I ended up in such a situation unintentionally.
Next, as an attorney, I would make dual arguments....one that constructive possession was not met, and secondly, even if it were, 'other lawful purpose' would apply. From there, it would be up to the judge and jury how they decided and for what reasons.
Despite my personal desire to see this question answered in court, it would simply be foolish to rely on that argument alone, unless you were intentionally engaging in what would certainly be a very bold "activist" move.Get your "Guns Save Lives" stickers today! PM for more info.

TOWAMENCIN - Man charged with weapons possession
Christopher Anfuso, 40, of the 400 block of Vincent Road, Willow Grove, was charged with possession of a weapon on school property on Monday by Towamencin police.
According to police, staff at North Montco Technical Career Center contacted Towamencin police following their investigation of a report that an adult education student may have a firearm in his vehicle on school property.
The adult student reportedly had made remarks about the gun to another student and the school began an investigation, police said.
Police said they responded to the school at 12:34 p.m. Monday, and a semi-automatic pistol with a loaded magazine was found in the vehicle.
Anfuso possessed a permit to carry a firearm at the time of the incident, but it is still illegal for him to bring the weapon on school property, police said. Anfuso was taken into police custody. No threat to use the firearm or other threat of violence was reported, police said.
He was arraigned by District Judge Harold Borek of Lansdale and was released on $10,000 10 percent bail.

i agree he should not post the specifics of his deal until he is in the clear. but maybe he could start a thread keeping us updated on how things are going. let us know if it looks good or bad. or maybe we should shart a pool to make sure he gets the best legal aid he can have. it will benefit all of us if he wins.

He could simply state his name and relation to a particular new story or quote...from there, he could just sit back and collect information that his attorney may or may not find useful.
