Darby Borough man charged after firearms are confiscated
Published: Tuesday, October 6, 2009
Cash, ammunition and weapons seized by the Darby Borough Police Department are displayed at the police station Monday.
DARBY — A convicted felon is under arrest after police confiscated a stockpile of guns, ammunition, suspected drugs and more than $27,000 in cash from his Mulberry Street garage.
Police are trying to identify the source of the weapons found in a garage owned by Andrew Cuff, 52, a convicted felon who is barred from owning weapons.
According to court documents, a woman’s name was found on paperwork for a gun found inside Cuff’s garage.
Police Chief Robert Smythe said the woman, who has not been charged with a crime and whose name is being withheld by the Daily Times, was being investigated by the Pennsylvania Attorney General’s office in connection with the straw purchase of a weapon.
“She’s not under investigation by us,” Smythe said. “She is currently under investigation by the attorney general’s office.”
A spokesman for the attorney general said the woman is not the focus of an investigation by their office.
“She’s not the subject of an investigation by our Gun Violence Task Force,” said Kevin Harley, spokesman for state Attorney General Tom Corbett.
Harley said the A.G.’s office assisted Darby Borough in its investigation.
“It is not our investigation, it is Darby Borough’s,” Harley said.
Smythe said the probe was launched after a 9 mm semiautomatic handgun was recovered from underneath a seat of a rental car Cuff returned to Enterprise in Philadelphia last week.
The registered owner of the gun told investigators it had dropped out of her pocketbook when she was in the car with Cuff.
“She said she was in the car and somehow it must have fallen out of (her) purse,” Smythe said.
That person was interviewed by investigators from the state attorney general’s Gun Violence Task Force, but no charges were filed.
On Sept. 29, Darby Borough police executed a search warrant at Huff’s Mulberry Street garage. Inside of the garage, police found a black Mossberg 12-gauge bolt-action shotgun, a 12-gauge Sears and Roebuck shotgun, a stockpile of ammunition, pills, suspected marijuana, $27,250 in cash and other items.
Mail addressed to Cuff was also confiscated, according to the affidavit of probable cause.
Cuff, of the 100 block of Mulberry Street, surrendered to authorities Monday. He was arraigned by Magisterial District Judge Leonard V. Tenaglia on charges of person not to possess, use, sell manufacture firearms, possession of a controlled substance, possession with the intent to deliver and possession of drug paraphernalia and released on 10 percent of $50,000 bail.
“This is still an open investigation and there are still questions that have to be answered,” Smythe said.
Cuff is scheduled to appear before Tenaglia Oct. 14 for a preliminary hearing.

Re: Darby Borough man charged after firearms are confiscated
The word stockpile is a stretch.....but,this guy is a convicted felon. He is,as I know you know...forbidden from having any gun.
So we have a high crime town, that has a curfew & we have cause to believe that a local elected official may be straw buying for a convicted felon. What's wrong with this picture??
I would like to see the ATF look into this.

Re: Darby Borough man charged after firearms are confiscated
I think the news media measures in increments of how many fit in the gun:
capacity +1= "extra ammunition"
capacity +2= "numerous rounds of extra ammunition"
capacity +3= "ammunition all over the place"
capacity +4= "ammunition cache"
capacity +5= "ammunition stockpile"
capacity +6 or more= "huge ammunition stockpile"

Forget about media semantics/terminology....this guy is a prohibited person..period.
It sounds like the authorities really have this one under control???
I'm guessing someone will lift the carpet while someone else operates the broom.
We should flood the ATF & perhaps Tom Corbett's office with calls to address this issue. I'll be the first to call.Last edited by reverserboy; October 6th, 2009 at 11:56 AM.

To quote the councilwoman's brother, a constable, "If she did, what they call a 'straw purchase', she would be locked up."Last edited by anonymouse; October 6th, 2009 at 04:03 PM.
