At our most recent Tea Party meeting last week.
The gun rights attorney that spoke. Mentioned a court case he recently learned about.
I seem to recall the case was concerning open carry being probable cause for searches.
I do not remember the details such as names of people involved, where it occurred, etc...
I'm waiting for the video of the meeting to be posted. So I can recall the details and verify I'm not completely wrong.
BUT
I 99% certain the gist was this.
- The case is before the PA Supreme Court.
- The defendant was stopped and searched simply because he was open carrying.
- The defendant's attorney is a public defender who does not know PA's gun laws.
- The attorney that spoke at our meeting is rushing to get some info together to help the defendant's case.
- The news media and anti-gun crowd has been doing everything they can to keep it quiet about this case.
- I think the case is about to be tried soon. Such as possibly Dec 2017 or Jan 2018.
Does anyone else know what case this might be ?--ET

Yeah but that is not the Eastern District of PA so most likely the decision is not applicable to Philly.

The video concerning the case of simply open or concealed carrying being reasonable suspicion is now available.

Appears to be contradictory court cases. The one in PA is at State Supreme Court level and a Public Defender is handling. I hope people help him out for free. We don't need to have OC listed as probable cause legally anymore than driving a muscle car means you might have been speeding so let me read your GPS or car computer!
ETA = Also, I hope people would look at Commonwealth (PA) vs. Hawkins. In there they give a hint about how ridiculous probable cause because of a firearm is.It is you. You have all the weapons that you need. Now fight. --Sucker Punch
