Folks - let's spread this story far and wide and get the word out - open carriers get fourth Amendment protection too!
Please sign up for a DIGG.com account and DIGG this news column - REDDIT the story too if you have time.

examiner.com — On September 8, 2009, United States District Judge Bruce D. Black of the United States District Court for New Mexico entered summary judgment in a civil case for damages against Alamogordo, NM police officers. The Judge’s straight shootin’ message to police: Leave open carriers alone unless you have “reason to believe that a crime [is] afoot.” . . .

Very good. Not only do we have Commonwealth v Hawkins at the state level, but now we also have a decision at the federal level. Even though it's not in our federal court district, it's still helpful.

A very important issue is how the judge denied the officers "qualified immunity"!!

Wow. Case is a great read. It looks as though the judge reads PAFOA??

I am VERY happy to see that "Qualified Immunity" was shot down. You can not simply TRAMPLE someones Constitutional Rights and then claim "Whoo can't touch me! Immunity!" like you are in a friggin' Lethal Weapon movie...
Hopefully a jury awards him a reasonable amount for his troubles in the following civil suit.FNX-9 Two-tone

Let's see, It's ok for LEO's and the government to entrap us in order to get a conviction, then cry foul when the same tactics are used against them.
