    Default LTCF reference check data point

    Quick Data point.

    Warren County Sherrif's office called me as reference for a neighbors' LTCF application.

    1 question only: "Is there any reason _____ should not be licensed to carry a firearm?"

    I was delighted to hear that is all they ask.

    So my neighbor should shortly be issued the LTCF.

    Chalk up another one for ZeroBama!

    Seems to me the deputy violated the law in asking you that particular question.

    §6111. Sale or transfer of firearms.
    (i) Confidentiality.-- All information provided by the potential purchaser, transferee or applicant, including, but not limited to, the potential purchaser, transferee or applicant's name or identity, furnished by a potential purchaser or transferee under this section or any applicant for a license to carry a firearm as provided by section 6109 shall be confidential and not subject to public disclosure. In addition to any other sanction or penalty imposed by this chapter, any person, licensed dealer, State or local governmental agency or department that violates this subsection shall be liable in civil damages in the amount of $1,000 per occurrence or three times the actual damages incurred as a result of the violation, whichever is greater, as well as reasonable attorney fees.

    T'wasn't public disclosure.
    T'was a private (professional) phone call to verify a reference.

    She was very polite and friendly and professional.

    It was a public disclosure.

    It was contact with someone other than the applicant which turns it from private to public.

    $1,000 for free!

    Note "as well as reasonable attorney fees."

    Like money growing on a tree and you teach the sheriff a great lesson in respecting the rights of others.!

    I was the reference the applicant listed. Howinthehell can the cops check a reference without disclosing the applicant's name?

    He could have asked about character without mentioning "license to carry firearm"....???

    Hmm... I was a reference for a friend of mine and they asked me 4 questions. Basically like you one question split into 3 questions (drugs, mental, attitude) but the first question was how long I knew the applicant.

    Oh come on guys.

    The only way this was a "disclosure" would be if that neighbor didn't tell the OP that OP's name, address and phone number appears on an LTCF application. And now in order to not "disclose" that the call is in connection with such application, the sheriff/deputy asks about the neighbor's character, drinking habits, possible domestic violence that hadn't been reported and stuff like that? That's so much better?

    OP didn't say it, but I think it is reasonable for the sheriff/deputy to assume that the two references, listed on the application, are already aware that such application is filed.

    There is never a reason to check the employer nor the references.

    Let's put it this way: It doesn't make sense to check them, because the people, we all want to be filtered out, know people that won't tell the sheriff anything anyway. That however only means that listing references or disclosing your employer doesn't make sense in the first place.

    Ever noticed that there is more "common nonsense" than "common sense"?
