Gifting some guns
My grandson is coming for a visit from New Mexico. He is now 21 I have promised him a couple Rifles and Handguns. I do not think the Rifles should be a problem. I plan on getting an Air line approved gun case for him. Would there be a problem with gifting the handguns to a resident of New Mexico. And if it is legal could the handguns be in the same case as the rifles.

you have to be careful transferring guns across state lines it might be considered gun trafficking

I gave him a shotgun a couple years back, I went through an FFL. May be safer to just use an FFL after he returns home. No reason to take a chance just to save a couple bucks.

My Google-fu is not strong tonight so I don't have sources to cite so take what I have to say with a grain of salt.
All interstate transfers must go through a FFL. There is no family exception for interstate transfers not withstanding estate transfers.
Now long guns may be transfered in either state, but handguns must be transfered in the receivers home state. So he can receive the long guns via FFL transfer during his visit, but the hand guns you would either have to send to a FFL in his state (and most likely through another FFL in your home state) or take them to his state yourself and do the transfer there."No, it's just a machine. Not sure how "solid" this answer is either (and why are you asking internet strangers) but from what I understand like Quackxp said..........Transfers between relatives (including grandparents) at any time within Pa is OK (per state law). No FFL required. For interstate transfers the federal government doesn't have this exemption. They will except transfers (or lack of) for an estate or will. But that means you will have to die first.......
The odds of black helicopters circling your grandsons house and kicking in his door are very remote. But a $25 transfer for a rifle (can be done in Pa) is cheap insurance. Handguns are more of a problem. You are supposed to get them shipped (expensive) to his state then he does the transfer.
Might be a fine line but..... if you "gave" the firearms to him when you were both residents of PA it should be OK. Did you "give" them to him when he was 9 and living here? Then he could take them to NM?
OK, I'm reaching on this and I am sure someone will tell me there's a law about it.....I am not a lawyer. And you should only trust one for advice (but he will charge a lot more than I do).Last edited by Delkal; July 31st, 2015 at 11:15 PM.

I've given my daughter a rifle, shotgun, and hand gun or two and over the 20 some years these firearms have left the state when she moved around. She was a resident of PA (in the military at the time some gifts).

Since the transaction crosses state lines, the blood relationship is irrelevant. The long guns must be transferred via an FFL in any state. The handguns will have to be transferred through an FFL in NM.
